Fithian RELEASE Cumberland County Estate No. 2010-01141 The undersigned, having full authority to do so, hereby executes this Release for the purposes herein set forth. In the Estate of Bernice Fithian, a/k/a Bernice M. Fithian, Date of Death 11/11/2010, CIS # 610132201, SSN ###-##-7493, Cumberland County Estate No. 2010-01141, PA Department of Revenue No. 21-10-1141, the Department of Public Welfare filed a lien for $662,317.31 ($32,367.15 as a Class 3 claim and the remainder as a Class 5.1 claim). The Executor, Jered L. Hock, has provided an informal but adequate and reasonable informal accounting far this size estate, which accounting shows a balance of $5,395.99, after payment of administrative and other debts, costs, and expenses. The Executor represents that he has advertised the estate as required by law (complete advertisement having occurred more than a year prior hereto), has received no claims other than those of the Department of Public Welfare and those set for in the inheritance tax return which was accepted as filed by the PA Department of Revenue, and proposes to settle the claim of the Department of Public Welfare by paying to it the said remaining sum of $5,395.99 in exchange of the said Department's Release, without the filing of a formal account or small estate petition with the court. The foregoing procedure is acceptable to the said Department, which, upon receipt of the aforesaid sum of $5,395.99, will release the Estate and Executor and agree, to the extent of said sum received, to refund said sum in the event valid claims are received, although the same are not at this point anticipated. This Release constitutes a release of the Pennsylvania Department of Public Welfare only to the extent of those assets of the decedent as set forth in the accounting attached hereto, and shall not constitute a relaease of any claim of said Department in and to any other assets presently in the hands of the Executor, in the hands of any other person, or which may be hereafter discovered.
