NOW COMES the Borough of Mechanicsburg Cumberland County,
Pennsylvania, by its attorney Lisa Marie Coyne, Esquire, and files the within claim
for charges assessed with respect to sewer and /or refuse rates against above
named owner or owners and against the hereinafter described real estate as
follows:
STATEMENT OF CLAIM
1. This claim is filed by the Borough of Mechanicsburg, a borough organized
and existing in accordance with the laws of the Commonwealth of
Pennsylvania.
2. The owner or reputed owner of the property, or party or parties
responsible or liable, for which this claim is filed is the Defendant(s).
3. The authority under which the sewer and/or refuse rates were changed
and assessed is the Act of July 18, 1935, P.L. 1286, Section 1, 53 P.S. § 2231,
as amended.
4. Plaintiff has made demands for payment for services; however,
Defendant(s) have not made payments for the services provided.
5. The authority under which this claim is filed is the Act of May 16, 1923
P.L. 207, Section 9, et se g., 53P.S. §7143, as amended.
6. A description of the property against which this claim is filed is:

7. This claim has not been the subject of any previous claim and judgment
in the Court of Common Pleas of Cumberland County for sewer and/or
refuse charges.
8. The total amount of the charges for which this claim is filed is
five hundred and fifty six and 77/100 dollars ($556.77), plus costs and
reasonable attorney's fees.
9. The time period for which these charges are filed is July 1, 2011 to June 30,
2012 on
Sewer Account 2409-0.
WHEREFORE, Claimant requests that a Municipal Lien be entered in its
favor and against the Defendant in the amount of five hundred and fifty six and
77/100 dollars ($556.77), plus cost and reasonable attorney's fees.

THIS INDENTURE
MADE the ?4" day of February, in the year of our Lord Two Thousand Twelve (2012),

DAVID A. SHORTER and BRENDA R. SHORTER, husband and wife,
GRANTORS
and
DAVID A. SHORTER, an adult individual, of Cumberland County, Pennsylvania,
GRANTEE
WITNESSETH that in consideration of the sum of One ($1.00) Dollar, in hand paid, the
receipt whereof is hereby acknowledged, the said Grantors do hereby grant and convey to the
said Grantee, his successors and assigns,
ALL THAT CERTAIN lot of ground with improvements thereon, situate on the north
side of East Keller Street in the Second Ward of the Borough of Mechanicsburg, Cumberland
County, Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a point on the building line on the north side of East Keller
Street at corner of lands now or formerly of Ray S. Aulthouse and Martha M. Aulthouse,
his wife; thence in a northerly direction through the partition wall separating a double
two story frame dwelling house known as Nos. 25 and 27 East Keller Street, along the
lands now or fornzerfy of Ray S. Aulthouse and Martha M. Aulthouse, his wife, and
through. the partition separating the garages on the aforesaid properties one hundred and
twenty-eight (128) feet, more or less, to the southern line of King Alley; thence in a
westerly direction along the southern line of King Alley twenty-four and six-tenths (24.6)

feet to a post on line of other lands now or formerly of Otis H. Aulthouse and Mary E.
Aulthouse; thence in a southerly direction along other lands now or formerly of Otis H.
Aulthouse and Mary E. Aluthouse one hundred twenty-eight (128) feet, more or less, to a
post on the building line on the north side of East Keller Street; thence in an easterly
direction along the building line on the north side of said East Keller Street twenty-five
and six-tenths (25.6) feet to a point, the place of BEGINNING.
BEING THE SAME PREMISES which Jeffrey M. Rioux and Trang L. Rioux, husband
and wife, by their deed dated March 15, 2007 and recorded March 22, 2007 in the Recorder of
Deeds Office in and for Cumberland County, Pennsylvania at Record Book 279, Page 1116,
granted and conveyed to David A. Shorter and Brenda R. Shorter, husband and wife, Grantors
herein.
UNDER and SUBJECT to restrictions and conditions as now appear of record.
AND the Grantors for their selves, their heirs, executors and administrators, do by these
presents, hereby covenant, grant and agree to and with the Grantee, his heirs and assigns, that
they, the Grantors, their heirs and all and singular the hereditaments and premises hereinabove
described and granted or mentioned and intended so to be, with appurtenances, unto the Grantors
and their heirs and against all and every other person or persons whomsoever, lawfully claiming
or to claim the same or any part thereof, by, from or under them, them or any of them, shall and
will, by these presents, SPECIALLY WARRANT AND FOREVER DEFEND.
THIS DEED IS A CONVEYANCE FROM HUSBAND AND WIFE TO HUSBAND
AS PART OF A DIVORCE PROCEEDING AND IN PARTIAL SETTLEMENT OF
CLAIMS FOR EQUITABLE DISTRIBUTION; WHEREFORE, NO REALTY
TRANSFER TAX IS DUE THEREON.
IN WITNESS WHEREOF, the Grantors have hereunto set their hands and seals, the
