NOW COMES the Borough of Mechanicsburg Cumberland County,
Pennsylvania, by its attorney Lisa Marie Coyne, Esquire, and files the within claim
for charges assessed with respect to sewer and /or refuse rates against above
named owner or owners and against the hereinafter described real estate as
follows:
STATEMENT OF CLAIM
1. This claim is filed by the Borough of Mechanicsburg, a borough organized
and existing in accordance with the laws of the Commonwealth of
Pennsylvania.
2. The owner or reputed owner of the property, or party or parties
responsible or liable, for which this claim is filed is the Defendant(s).
3. The authority under which the sewer and/or refuse rates were changed
and assessed is the Act of July 18, 1935, P.L. 1286, Section 1, 53 P.S. § 2231,
as amended.
4. Plaintiff has made demands for payment for services; however,
Defendant(s) have not made payments for the services provided.
5. The authority under which this claim is filed is the Act of May 16, 1923
P.L. 207, Section 9, et seq., 53P.S. §7143, as amended.

6. A description of the property against which this claim is filed is:

7. This claim has not been the subject of any previous claim and judgment
in the Court of Common Pleas of Cumberland County for sewer and/or
refuse charges.
8. The total amount of the charges for which this claim is filed is
one thousand twenty six and 42/100 dollars ($1026.42), plus costs and
reasonable attorney's fees.
9. The time period for which these charges are filed is April 1, 2011 to June 30,
2012 on
Sewer Account 5743-0.
WHEREFORE, Claimant requests that a Municipal Lien be entered in its
favor and against the Defendant in the amount of one thousand twenty six and
42/100 dollars ($1026.42), plus cost and reasonable attorney's fees.

This Indenture, made the 11th day of December, 2009,

JESSE T. POWNELL and CARLY A. POWNELL
(hereinafter called the Grantees), of the other part,
Witnesseth, that the said Grantor for and in consideration of the sum of One Hundred Forty-Four
Thousand And 00/100 Dollars ($144,000.00) lawful money of the United States of America, unto her
well and truly paid by the said Grantees, at or before the sealing and delivery hereof, the receipt whereof
is hereby acknowledged, has granted, bargained and sold, released and confirmed, and by these presents
does grant, bargain and sell, release and confirm unto the said Grantees, as tenants by the entirety, their
heirs and assigns,
ALL THAT CERTAIN house or lot of ground situate in the Borough of Mechanicsburg,
County of Cumberland and Commonwealth of Pennsylvania, more particularly bounded
and described as follows, to wit:
BEGINNING at a point in the western right of way line of South Broad Street (60 feet
wide) which said point is in the division line between Lots Nos. 1 and 2 on the hereinafter
mentioned Plan of Lots; thence extending along the division line between Lots Nos. 1
and 2 on said Plan and passing through the center line of a party wall between the double
two and one-half story concrete block dwelling erected on the lot herein described and on
the lot immediately adjacent to the North hereof and which is known as 116 and 114
South Broad Street respectively and continuing along said division line and passing
through the center line of a party wall or a double concrete block garage building erected
on the rear of said Lots Nos. 1 and 2 above mentioned South 79 degrees 00 minutes
West, a distance of 137.13 feet to a point marked by a nail in a 16 foot wide alley; thence
extending along said alley, South 21 degrees 00 minutes East, a distance of 21.80 feet to
a point marked by an iron pin at corner of Lot of Victor Hoffman and wife, thence
extending along the line of said Victor Hoffman and wife, North 79 degrees 00 minutes
East, a distance of 137.13 feet to a point marked by an iron pin in the western right of
way line of South Broad Street, North 21 degrees 00 minutes East, a distance of 21.80

feet to a point in the division line between Lots Nos. 1 and 2 on the hereinafter mentioned
Plan of Lots, first above mentioned, at the point and place of BEGINNING.
BEING Lot No. 2 on the Final Subdivision Plan for Amy S. Bear, which Plan is recorded in the Office of
the Recorder of Deeds in and for Cumberland County, Pennsylvania in Plan Book 33, Page 105.
BEING known and numbered as 116 South Broad Street Borough of Mechanicsburg, Cumberland
County, Pennsylvania.
BEING the same premises which Laurel Windsor, an adult individual, by Deed dated
July 18, 2005, and recorded July 21, 2005, in the Office of the Recorder of Deeds in and
for the County of Cumberland, Pennsylvania, in Book 269, Page 5080, granted and
conveyed unto 116 Broad Street Partners, a Pennsylvania General Partnership, in fee.
Together with all and singular the buildings and improvements, ways, streets, alleys, driveways,
passages, waters, water-courses, rights, liberties, privileges, hereditaments and appurtenances, whatsoever
unto the hereby granted premises belonging, or in anywise appertaining, and the reversions and
remainders, rents, issues, and profits thereof; and all the estate, right, title, interest, property, claim and
demand whatsoever of her, the said grantor, as well at law as in equity, of, in and to the same.
To have and to hold the said lot or piece of ground described above, with the buildings and
improvements thereon erected, hereditaments and premises hereby granted, or mentioned and intended so
to be, with the appurtenances, unto the said Grantees, their heirs and assigns, to and for the only proper
use and behoof of the said Grantees, their heirs and assigns, forever.
And the said Grantor, for herself and her heirs, executors and administrators, does, by these presents,
covenant, grant and agree, to and with the said Grantees, their heirs and assigns, that she, the said Grantor,
and her heirs, all and singular the hereditaments and premises herein described and granted, or mentioned
and intended so to be, with the appurtenances, unto the said Grantees, their heirs and assigns, against her,
the said Grantor, and her heirs, and against all and every other person and persons whosoever lawfully
claiming or to claim the same or any part thereof, by, from or under him, her, it, or any of them, shall and
will
