MUNICIPAL LIEN FOR SEWER/WATER RATES
NOW COMES the Borough of Mechanicsburg Cumberland County,
Pennsylvania, by its attorney Lisa Marie Coyne, Esquire, and files the within claim
for charges assessed with respect to sewer and /or refuse rates against above
named owner or owners and against the hereinafter described real estate as
follows:
STATEMENT OF CLAIM
1. This claim is filed by the Borough of Mechanicsburg, a borough organized
and existing in accordance with the laws of the Commonwealth of
Pennsylvania.
2. The owner or reputed owner of the property, or party or parties
responsible or liable, for which this claim is filed is the Defendant(s).
3. The authority under which the sewer and/or refuse rates were changed
and assessed is the Act of July 18, 1935, P.L. 1286, Section 1, 53 P.S. § 2231,
as amended.
4. Plaintiff has made demands for payment for services; however,
Defendant(s) have not made payments for the services provided.
5. The authority under which this claim is filed is the Act of May 16, 1923
P.L. 207, Section 9, et seq., 53P.S. §7143, as amended.

6. A description of the property against which this claim is filed is:

7. This claim has not been the subject of any previous claim and judgment
in the Court of Common Pleas of Cumberland County for sewer and/or
refuse charges.
8. The total amount of the charges for which this claim is filed is
nine hundred eighty seven and 35/100 dollars ($987.35), plus costs and
reasonable attorney's fees.
9. The time period for which these charges are filed is April 1, 2011 to June 30,
2012 on
Sewer Account 1556-0.
WHEREFORE, Claimant requests that a Municipal Lien be entered in its
favor and against the Defendant in the amount of nine hundred eighty seven and
35/100 dollars ($987.35), plus cost and reasonable attorney's fees.

THIS INDENTURE, made the day of in the year of our
Lord Two Thousand Nine (2009).
BETWEEN BRUCE ALLEN HOMES, INC., a Pennsylvania Corporation,
GRANTOR, Party of the First Part,
Part,
WITNESSETH that the said Party of the First Part, for and in consideration of the
sum of ONE HUNDRED SEVENTY THOUSAND ($170,000.00) DOLLARS, lawful
money of the United States of America, well and truly paid by the said Party of the Second
Part to the said Party of the First Part, at and before the sealing and delivery of these
presents, the receipt whereof is hereby acknowledged, have granted, bargained, sold,
alienated, enfeoffed, released, conveyed and confirmed and by these presents does grant,
bargain, sell, alien, enfeoff, release, convey, and confirm unto the said Parry of the Second
Part, their heirs and assigns.
ALL THAT CERTAIN piece, parcel and tract of land situate in the Borough of
Mechanicsburg, County of Cumberland, State of Pennsylvania, more particularly
bounded and described as follows, to wit:
BEGINNING at a hub in South Frederick Street, which said hub is North ninety-eight
and eighty hundredths (98.80) feet from the northwest corner of South Frederick Street
and West Marble Street; thence along lands now or formerly of C. Schultz, South eighty
(80) degrees twenty-two (22) minutes thirty (30) seconds West, a distance of two hundred

twenty (220) feet to a hub on the eastern line of a twenty (20) foot alley; thence along the
eastern line of said alley, North ten (10) degrees three (3) minutes West, a distance of
fifty and forty-four hundredths (50.44) feet to a nail; thence along lands now or formerly
of Minnie F. Fry, North eighty (80) degrees fifty-three (53) minutes twenty (20) seconds
East, a distance of twenty-three and eleven hundredths (23.11) feet to a point; thence
further by same, South nine (9) degrees six (6) minutes forty (40) seconds East, a
distance of three and eighty-five hundredths (3.85) feet to a point; thence by same and
along a fence, North eighty (80) degrees thirty-two (32) minutes twenty (20) seconds
East, a distance of one hundred seventeen and eighty-three (117.83) feet to a point;
thence still by same, North nine (09) degrees fifty-five (55) minutes West, a distance of
five and fifty-five hundredths (5.55) feet to a point; thence through the center of a frame
partition wall of a double house and beyond, North eighty (80) degrees five (5) minutes
East, a distance of seventy-nine and ten hundredths (79.10) feet to a nail in said South
Frederick Street; thence along said South Frederick Street, South ten (10) degrees three
(3) minutes East, a distance of fifty-two (52) feet to a hub, the point and place of
BEGINNING.
HAVING THEREON ERECTED the southern half of a two and one-half story frame
dwelling house known and numbered as 420 South Frederick Street and a one-story
frame garage.
The aforesaid description is made in accordance with a survey made by John C. Brillhart,
R.S., on February 26, 1969.
BEING PART OF THE SAME PREMISES which Eric J. Krouch and Marie R.
Krouch, husband and wife, granted and conveyed unto Bruce Allen Homes, Inc., by deed
dated June 20, 2008 and recorded June 27, 2008 in the Recorder of Deeds Office in and
for Cumberland County, Pennsylvania in Record Instrument Number 200821899.
UNDER and SUBJECT to restrictions and conditions as now appear of record.
AND THE SAID Party of the First Park, for themselves, their heirs, executors and
administrators, does by these presents, covenant, grant and agree to and with the said Party
of the Second Part, their heirs and assigns, that they, the said Party of the First Part, their
heirs all and singular the hereditaments and premises hereinabove described and granted or
mentioned and intended so to be, with appurtenances, unto the said Party of the Second Part,
their heirs and assigns, against the said Party of the First Part and their heirs and against all
and every other person or persons whomsoever, lawfully claiming or to claim the same or
any part thereof, by, from or under them, them or any of them, shall and will, by these
presents, SPECIALLY WARRANT AND FOREVER DEFEND.
