MUNICIPAL LIEN FOR SEWER/WATER RATES
NOW COMES the Borough of Mechanicsburg Cumberland County,
Pennsylvania, by its attorney Lisa Marie Coyne, Esquire, and files the within claim
for charges assessed with respect to sewer and /or refuse rates against above
named owner or owners and against the hereinafter described real estate as
follows:
STATEMENT OF CLAIM
1. This claim is filed by the Borough of Mechanicsburg, a borough organized
and existing in accordance with the laws of the Commonwealth of
Pennsylvania.
2. The owner or reputed owner of the property, or party or parties
responsible or liable, for which this claim is filed is the Defendant(s).
3. The authority under which the sewer and/or refuse rates were changed
and assessed is the Act of July 18, 1935, P.L. 1286, Section 1, 53 P.S. § 2231,
as amended.
4. Plaintiff has made demands for payment for services; however,
Defendant(s) have not made payments for the services provided.
5. The authority under which this claim is filed is the Act of May 16, 1923
P.L. 207, Section 9, et seq., 53P.S. §7143, as amended.

6. A description of the property against which this claim is filed is:

7. This claim has not been the subject of any previous claim and judgment
in the Court of Common Pleas of Cumberland County for sewer and/or
refuse charges.
8. The total amount of the charges for which this claim is filed is
five hundred thirty two and 40/100 dollars ($532.4), plus costs and reasonable
attorney's fees.
9. The time period for which these charges are filed is April 1, 2011 to June 30,
2012 on
Sewer Account 7268-0.
WHEREFORE, Claimant requests that a Municipal Lien be entered in its
favor and against the Defendant in the amount of five hundred thirty two and
40/100 dollars ($532.4), plus cost and reasonable attorney's fees.

by reason of marriage EMILY A. NICKEY, husband and wife,
and as Power of Attorney on behalf of SCHUYLER K.
NICKEY, of Cumberland County, Pennsylvania, hereinafter
referred to as
(Grantors)
and MARK V. McMULLEN of Cumberland County, Pennsylvania,
hereinafter referred to as
(Grantee)
WITNESSETH, that in consideration of one Hundred Eleven Thousand
Nine Hundred Dollars and 00/100 ($111,900.00) in hand paid, the
receipt whereof is hereby acknowledged, the said grantors do
hereby grant and convey to the said grantee,
assigns:
ALL THAT CERTAIN unit in the property known, named and identified
in the Declaration referenced to below as "'Walnut Villas
Condominium" located in the Borough of Mechanicsburg,
Cumberland, Commonwealth of Pennsylvania, which has heretofore
been submitted pursuant to the provisions of the Pennsylvania
Uniform Condominium Act, 68 Pa. Cons. Stat_ Ann. 3101 et seq.,
(Purdon Supp. 1988), by the recording in the office of the
Recorder of Deeds of Cumberland County, 1985n and are, o on rded
Declaration of Condominium dated July 30, 147, which
August 14, 1985, in Misc. Book Vol. 308, Page

further amended by a Second Amendment to Declaration

to Declaration of Condominium dated June 12, 1987, and recorded on
June 12, 1967, in the aforesaid office at Misc. Book 335, Page
283, and further amended by a Fourth-Amendment to Declaration of
Condominium dated November 10, 1987, and recorded on November 30,
1987, in the aforesaid office at Misc. Book 343, Page 368, and

aforesaid office at Misc. Book 355, Page 1084, being and
designated in such Declaration, as so amended, as Unit No. 759 as
more fully described in such Declaration, as so amended together
with a proportionate undivided interest in the Common Elements of
such Condominium as set forth in such Declaration as so amended
and as further amended by any further amendments thereto hereafter
recorded in the aforesaid office.
BEING the same premises which Lester G. Kissinger, Jr. and Deborah
Anne Kissinger, husband and wife and Mary Frances Potter, single
person, by deed dated April 14, 2006, and recorded in the office
of the Recorder of Deeds in and for Cumberland County in Deed Book
274, Page 293, granted and conveyed unto Schuyler K. Nickey and
Emily A. Marshall now by reason of marriage Emily A. Nickey,
husband and wife, and as Power of Attorney on behalf of SCHUYLER
K. NICKEY, Grantors herein.
UNDER AND SUBJECT, NEVERTHELESS, to all easements, restrictions,
encumbrances and other matters of record or that which a physical
inspection or survey of the premises would reveal.
TOGETHER with all and singular the buildings, improvements, ways,
woods, waters, watercourses, rights, liberties, privileges,
hereditaments and appurtenances to the same belonging or in
anywise appertaining; and the reversion and reversions, remainder
and remainders, rents, issues and profits thereof, and of every
part and parcel thereof; AND ALSO all the estate, right, title,
interest, use, possession, property, claim and demand whatsoever
of the Grantors both in law and in equity, of, in and to the
premises herein described and every part and parcel thereof with
the appurtenances. TO HAVE AND TO HOLD all and singular the
premises herein described together with the hereditaments and
appurtenances unto the Grantees and to the Grantees' proper use
and benefit forever.
AND the said grantors hereby covenant and agree that they
will warrant specially the property hereby conveyed.
IN WITNESS WHEREOF, said grantors have hereunto set their
