COMPLAINT Plaintiff, Kohl Roofing & Siding Co. t/a Kohl Building Products, by and through its attorneys, Silverman Theologou, LLP and Gary S. Silverman, Esquire hereby brings this action against Defendant Steve J. Yanek and states as follows: Parties 1. Plaintiff Kohl Roofing & Siding Co. t/a Kohl Building Products ("Kohl") is, and I I was at all times relevant hereto, a Pennsylvania corporation with its principal office at 1047 Old i { Bernville Road, Reading, PA 19605. 3 2. Defendant Steve J. Yanek ("Yanek") is and was at all times relevant hereto a Pennsylvania resident. 40554 r C Factual Background 3. On or about April 12, 2001 Yanek executed a personal guaranty ("Guaranty") wherein he agreed to be held personally liable for the account of Yanek Custom Homes, Inc. in the event of default by Yanek Custom Homes, Inc. A copy of the Guaranty is attached hereto as Exhibit A and incorporated herein by reference. 4. Pursuant to the terms of the Guaranty, Yanek agreed to pay interest in the amount of eighteen (18%) percent per annum on the unpaid balance of any amount past due. 5. Pursuant to the terms of the Guaranty, Yanek agreed to pay thirty-three and one third (33 1/3%) of the principal amount due for attorney's fees plus costs. COUNTI (Breach of Contract against Steven J Yanek) 6. Kohl incorporates paragraphs 1 through 5 in this Count I as if fully stated herein. 7. At the request of Yanek Custom Homes, Inc., from May 2011 through August 2011 Kohl provided building products to Yanek Custom Homes, Inc. on open account and sent invoices demanding payment. Yanek Custom Homes, Inc. has failed to pay the principal amount totaling thirteen thousand four hundred five and 77/100 dollars ($13,405.77). A true and accurate copy of the statement of account and corresponding invoices is attached hereto as Exhibit B and incorporated herein by reference. 8. On December 23, 2011 Yanek Custom Homes, Inc. filed bankruptcy under Chapter 7 in the United States Bankruptcy Court for the Middle District of Pennsylvania (Harrisburg) under case number 11-08438-MDF. 9. Despite due demand for payment and full performance by Kohl, Yanek has failed to pay Kohl pursuant to the Guaranty and is in breach thereof. 2 40554 .s' 10. As a result of the failure of Yanek to pay the sums due, Kohl has sustained damages in the following amounts: (a) principal in the amount of $13,405.77; (b) accumulated interest through October 31, 2011 in the amount of $585.14; (c) interest from October 31, 2011, on the principal balance of $13,405.77, in the amount of 1.5% per month (18% per annum); (d) attorney's fees in the amount of $4,468.59 (33 1/3% of the principal balance due); and (e) costs of this action. WHEREFORE, Plaintiff, Kohl Roofing & Siding Co. t/a Kohl Building Products demands judgment against Defendant Steve J. Yanek as follows: (a) principal in the amount of $13,405.77; (b) accumulated interest through October 31, 2011 in the amount of $585.14; (c) interest from October 31, 2011, on the principal balance of $13,405.77, in the amount of 1.5% per month (18% per annum); (d) attorney's fees in the amount of $4,468.59 (33 1/3% of the principal balance due); and (e) costs of this action.
