DEFENDANTS' PRELIMINARY OBJECTIONS TO THE COMPLAINT NOW, comes Debra Sue Rand, Counsel for Defendants, and files thes Preliminary Objections to the Complaint. 1. Plaintiff is Telly Royster, an inmate confined by the Pennsylvani Department of Corrections. 2. Plaintiff has filed a civil complaint seeking declaratory relief that his ri have been violated along with a demand for money damages. 3. Defendants are Adam Huber (a property officer at the State Correcti Institution ("SCI") at Camp Hill) and John Murray, Chris Richard Southers, John Horner and James Meintel, who are or supervisory personnel employed at SCI-Camp Hill at the time in question. 4. The gravamen of the Complaint concerns various property claims. 5. Plaintiff alleges that after being transferred from another correctional facilit, IC ` 0-TA F; 1tf11: 27 COUNTY 1N1A to SCI-Camp Hill, he was escorted to the property room on June 30, 2010 where he discovered that all of his property was not accounted for and his radio had been destroyed/altered. Complaint, ¶¶5, 12, 13. 6. He further avers that he was then forced to carry a box of his material apparently legal papers, down a flight of stairs and that he tripped and the contents of the box spilled. Complaint, ¶¶15-16. 7. Next, he claims that Defendant Huber, who was escorting him, would n uncuff him so he could pick up his property and that said property was discarded. Complaint, ¶¶17. 8. He further asserts that all the Defendants were negligent in storing hi property; authorized retaliatory misconducts and deceptive busines practices; were deliberately indifferent in failing to training correcti personnel regarding unspecified policies and procedures; were deliberatel indifferent when knowing that unconstitutional polices and practice exi they failed to establish procedures to protect Plaintiffs property rights; "wantonly disregarded and/or caused to be missing [Plaintiffs] property.' Complaint, ¶¶22-26. Pleading Standard 9. Pro se litigants whose choose to litigate in state court must adhere Pennsylvania's "fact-pleading system of jurisprudence" and do more merely allege a constitutional violation; the pleading must also state "th 2 material facts on which a cause of action or defense is based" before entitlement to the requested relief arises. Cimaszewski v. Board Probation and Parole, 582 Pa. 27, 37-38, 868 A.2d 416, 422 (2005). Demurrer- 42 U.S.C. Section 1983 (Pa. R.C.P. 1028(a)(4)) 10. To state a prima facie claim under 42 U.S.C. § 1983, a plaintiff must: 1; allege a violation of rights secured by the United States Constitution and laws of the United States and, 2) show that the alleged deprivation committed by a person acting under color of state law. Anelli v. A Lakes Community Association, Inc., 689 A.2d 357 (Pa. Cmwlth. 1997). 11. Further, Section 1983 liability also requires personal involvement whi cannot be imposed on a theory of respondeat superior. Rode Dellarciprete, 845 F.2d 1195 (3d Cir. 1988). 12. Allegations of participation or actual knowledge and acquiescence must made with appropriate particularity. Id. 13. As to Defendants Murray, Chambers, Southers, Horner and Plaintiff pleads no facts indicating any personal involvement. 14. He says only that they "collectively took possession of plaintiff's property collecting by way of defendant Huber." Complaint, ¶7. 15. This is patently a claim resting on a theory of respondeat superior cannot survive. 3 16. Further, to the extent the Complaint can be read to aver that Plaintiff i alleging a denial of court access it states no claim. 17. In order to state a cognizable claim for violation of the right to access to courts, a prisoner must allege and offer proof that he suffered an injury" to court access as a result of the denial. Lewis v. Casey, 518 U. 343, 351. 18. To meet this burden the inmate must demonstrate, for example, "that complaint he prepared was dismissed for failure to satisfy some techni requirement which, because of deficiencies in the prison's legal as facilities, he could not have known. Or that he had suffered arguabl actionable harm that he wished to bring before the courts, but was stymied by inadequacies of the law library that he was unable even to file complaint." Lewis, 518 U.S. at 356-57. 19. Plaintiff does not make such allegations with regard to his federal case No. 05-2063 (M.D. Pa). 20. Defendants ask this Court to take judicial notice of the official docket entri for that case which indicate that it is still ongoing. See Ex. A to the Preliminary Objections. 21. Thus, Plaintiff does not state a denial of court access claim under the standard. 4 Immunity-State Law Claims 22. Plaintiff's Complaint also alleges an intentional tort and negligence theori concerning his property. 23. The Commonwealth and its agencies are immune from suit except where Legislature specifically waives immunity. Article 1, Section 11 of Pennsylvania Constitution, Pa. Const. art. 1, § 11; 1 Pa. C. S. § 2310.' No Cause of Action for Intentional Tort 24. "[W]hen an employee of a Commonwealth agency was acting within scope of his or her duties, the Commonwealth employee is protected sovereign immunity from the imposition of liability for intentional claims." LaFrankie v. Miklich, 618 A.2d 1145, 1149 (Pa. Cmwl 1992)(citing Yakowicz v. McDermott, 548 A.2d 1330 (Pa. Cmwlth. 1988)). 25. "Unlike for local agency employees, willful misconduct does not vitiate Commonwealth employee's immunity because sovereign immunity a Commonwealth employee acting within the scope of his or employment from liability, even for intentional acts..." Holt v. N ' The affirmative defense of sovereign immunity may be raised by Prelimina Objection in the nature of a demurrer where such defense "is apparent on the fa of the pleading...." Wurth v. City of Philadelphia, 584 A.2d 403, 407 (F Cmwlth. 1990). In other words, it must be apparent that the cause of action do not fall within one of the statutorily defined exceptions to immunity. Id.; see al State Workman's Ins. Fund v. Caparo Real Estate Inc., 635 A.2d 705, 706 n. (Pa. Cmwlth. 1993). 5 Pa. Training Partnership Consortium, Inc., 694 A.2d 1134, 1140 Cmwlth. 1997). 26. Even if a plaintiff alleges that the employees acted outside the scope employment, if allegations center around their duties and powers employees, sovereign immunity is still a bar. See, e.g., LaFrankie, 618 1148 (despite allegations he acted outside his employment, trooper remai employee acting within course and scope of employment because his duti involved investigating, arresting and prosecuting cases). 27. To the extent that Plaintiff's avers an intentional tort, Defendant Huber acting within the scope of his duties when he refused to uncuff Plaintiff, extremely high level risk inmate, to facilitate Plaintiff's picking up his material. 28. It was Plaintiff's failure to pickup his materials, which handcuffs would prevent, not any action of Defendant Huber, that caused Plaintiff the loss o his property. 29. Further, Plaintiff makes no factual allegations regarding the Defendants as to this claim. 30. As to Plaintiff's claim that on June 30, 2012, he discovered that his radio been destroyed/altered, ¶13, he does not aver that any Defendant did so. 6 31. Accordingly, he has stated no cause of action for an intentional tort agai any Defendant. No Cause of Action for Negligence 32. To strip the defendant of sovereign immunity, for a negligence claim, plaintiff must first establish a cause of action in negligence and establish that his claim fell within an enumerated exception to sov immunity. 42 Pa. C.S. § 8522(a). 33. Section 8522(a) waives the defense of sovereign immunity as a bar to action against Commonwealth parties "for damages arising out of negligent act where the damages would be recoverable under the law or a statute which created a cause of action if the injury were caused a person not having available the defense of sovereign immunity." 34. It does so, however, only in nine enumerated circumstances. 35. One of the circumstances is the negligent destruction of "personal property, by state government personnel. See Section 8522(b) of the Judicial Code, 4 Pa. C.S. § 8522(b); Williams v. Stickman, 917 A.2d 915 (Pa. Cmwlth. 2007 petition for allowance of appeal denied, 594 Pa. 683; 932 A.2d 1290 (2007) 36. However, Plaintiff has identified no act of negligence on the part of Defendant because it was he who did not pick up his materials, resulting it their being discarded. 7 37. Further, any discarding of that material once abandoned, even if done Defendant Huber, was not negligent, but intentional, and within the scope o his duties. 38. As to Plaintiff's claim that on June 30, 2012, all of his property was accounted for, ¶13, it is too vague to state a claim under Cimaszewski. 39. As to Plaintiff's claim that on June 30, 2012, he discovered that his radio been destroyed/altered, ¶13, he does not aver that any :Defendant did so. 40. Therefore, Plaintiff has not stated a viable negligence claim. WHEREFORE, for the foregoing reasons Defendants respectfully req that this Court sustain their preliminary objections and dismiss the Complaint.
