FAMILY SETTLEMENT AGREEMENT

L. Stine and Donna H. Crist, testamentary heirs of Helen M. Heberl(~,;IMBERLANC CO.. PA
WITNESSETH, THAT:
~ 3 , 2011, survived by Judy L. Stine
WHEREAS, Helen M. Heberlig died
and Donna H. Crist; and
WHEREAS, Letters Testamentary were granted to Susan E. Feagley on
,q. at , 2011; and
WHEREAS, the undersigned, being all the testamentary heirs of the decedent, want to
settle the estate by agreement rather than by a formal accounting.
NOW, THEREFORE, in consideration of the mutual covenants of the parties, all
parties intending to be legally bound hereby, it is agreed as follows:
1. An informal, summary accounting of the receipts and expenditures in said
estate is attached hereto, denominated "Breakdown for settlement of real estate" and dated
February 3, 2012.
2. Each of the undersigned has been fully advised of her rights pertaining to
the filing of an account and each does hereby waive any right which she might have to compel
a formal court accounting prior to distribution of the estate.
3. Each of the undersigned accepts and approves the attached summary
accounting and agrees that this agreement shall have the same force and effect as if formal
accounting had been filed with and confirmed by the Orphans' Court of Cumberland County.
4. Each of the undersigned agrees that distribution shall be as stated in said
summary accounting.
5. We, and each of us, each in consideration of the promise of the other, do
hereby agree to refund to the estate, pro rata, any amount which may be necessary in the future
to discharge any liabilities to the estate of which we may hereafter receive notice.
6. We, Judy L. Stine and Donna H. Crist, and each of us, do hereby release
Susan E. Feagley of and from any and all claims we have under the law against the Estate of
Helen M. Heberlig and against Susan E. Feagley, the Executrix thereof.
'7. This agreement may be executed in multiple counterparts, and, when so
executed, shall be binding upon all the parties and their respective heirs, next-of--kin, personal
representatives and assigns.
IN WITNESS WHEREOF, we have hereunto set our hands and seals the day and
year first above appearing.
