COMPLAINT In good faith, I attempted to work with my former landlord to have her make good on promises she made for repairs and intolerable living conditions (the next door neighbor's middle of the night rages and Brian the building painter's drunken/drug rages). The situation deteriorated almost immediately. When I advised her that I was looking for another apartment (in the presence of Mr. David Stiber), she said she understood completely and apologized. When I found another apartment and told her on the telephone of my intent to vacate in sixty days, she asked me why. I followed up our conversation with a certified letter of intent to vacate and total monies owed me. She refused 3 attempts to deliver by the post office. When I sent a certified letter stating my forwarding address for the purpose of returning my money, she refused 3 attempts to deliver by the post office. May 9, 2012, I filed a civil complaint against my former landlord. She was served the notice. This is my answer to her appeal. I am not a vindictive person nor have I ever been in any sort of legal trouble. I simply want the money owed to me from a verbal agreement and to be done with this person so I can move on with my life. Enclosed please find the originals and two copies each of the original complaint along with my statement filed May 9th, along with various explanatory emails and letters and the final judgment in my favor. Sixty days from April 21, 2012 is June 21, 2012. Having given proper notice, as stated by you verbally and contained in the lease, the last month's rent that I paid upon entering the apartment ($650.00) should be prorated and applied for the twenty-one (21) days I will be here in June of 2012. The breakdown of the last month's rent is as follows: Monthly rent of $650.00 divided by thirty (30) days in June = $21.67 dollars per day. Twenty-one (21) days I will be staying here times $21.67 per day = a total of $455.00 due for June rent. $650.00 minus $455.00 = a $195.00 refund due to me. I had made arrangements for my sick, elderly mother (who had lived with my husband and me) to move to Homeland Center in Harrisburg January 17, 2012. Because I didn't know how my husband would react, my attorney Pamela Purdy, strongly advised me to move out of the home the same day as my mother. Immediately, I began to search for living arrangements. As I wasn't finding something immediately, I made reservations at a long-term hotel in Mechanicsburg for $3,000.00 per month. Then on January 7, 2012, I saw and answered an ad for an apartment located at 1004 Bridge St., 3rd floor, New Cumberland, PA (the ad was on Craig's List). The defendant, Ms. Tammie K. Sheaffer, agreed to show it to me that same day. A friend of mine, Mr. David Stiber, accompanied me. While the apartment was large, it was also very messy and very dirty. The defendant was extremely helpful and suggested that while repairs and cleaning were going on, I could move in to the apartment and save myself the money for the hotel. I did agree as all I could see was getting out of my home situation. The defendant promised many repairs would be done. I quickly made the necessary arrangements for a credit check, borrowed money from my mother to cover the defendant's requirement of 1st month's rent ($650), last month's rent ($650) and security deposit ($650) and $35 application fee up front. Since I would be living in the apartment for only part of January, paid a prorated amount of $400+. January 17, 2012, I moved my mother in at Homeland and came directly to my apartment. Almost immediately, problems arose about getting the promised work done and getting a hard copy of my lease. I made numerous phone calls to Ms. Sheaffer (either not returned or returned with excuses as to why work wasn't able to be done or why I couldn't get a copy of my lease), emails and text messages. This continued on until January 24, 2012 when I emailed the defendant a list of items that had to be done immediately. I also texted Ms. Sheaffer about having to have a hard copy of my lease. Either I wouldn't be answered, or she became agitated about my requests, or she told me she gave me the lease, or she didn't have a printer or she lost the lease, or she didn't have a cable for the printer. Many more problems arose, so that by the time the defendant finally emailed a copy of my lease towards the end of February I had made up my mind I had to end my lease and find a better place to live. Ms. Sheaffer came to my apartment with a copy of the lease to sign. I told her because of how she put me off, the problems with the "painter" Brian (who lived on the premises and was prone to drunken or drug rages and is now in jail), the next door neighbors (who raged incessantly and police came many times in the middle of the night for Colton's rages), the piles of furniture and junk that she would bring and pile up on the front porches, landings and generally anywhere she could find places to put stuff... I didn't feel safe and having to argue constantly for the necessary repairs was stressing me even more than I already was. I did not sign the lease. The defendant said she understood, that she was sorry about everything and that I could give a 60-day notice if I found a place. Mr. Stiber was present when she told me the latter. I continued to search for a new home. The problems continued... The tenant next door was eventually evicted; the then maintenance person, Joe Sturtz, who initially did some work in my apartment stopped working because he wasn't being paid by the defendant for work he performed (I also didn't feel comfortable around him) and 'holed up' in his basement apartment (on the premises) because he couldn't afford to move; the present maintenance person, Shainnon Auchey (asked each tenant for a list of things they needed done so he could get to work)..Ms. Sheaffer was very angry that he did that and wouldn't allow him to do the needed repairs here ; tenants recently received notices from PAWC that our water would be turned off the beginning of June for nonpayment, those tenants who use gas have just received notices from UGI that their gas will be turned off in a month for nonpayment. The problems do not stop. April 21, 2012, I called and gave the defendant my 60-notice to vacate. When she asked why I was leaving I told her there were a thousand reasons and that my therapist (Dr. Carol Chambers Mills) told me I do not have the 'emotional finances' to deal with this stress anymore. The call was followed up by a certified letter confirming my notice to vacate, the dates and the monies owed me when I leave (which she never collected and was returned to me). April 21, 2012, I found a new apartment in Camp Hill and will be moving there in June. I have tried to call the defendant and text her about the money she owes me. She claims she owes me nothing that "I saved you $1000. I owe you nothing." I claim she verbally contracted with me to allow me to leave the lease with a 60-day notice. May 8, 2012, I sent, via certified letter, to two of her known addresses, my forwarding address, the amount she owes me and to advise me where to leave the keys when I vacate the apartment. She told me I "used her and discarded her" and that I have no character. For my physical and emotional well-being, I must leave a place where I have never felt peaceful and am always on edge.
