NEIL, Defendants CIVIL ACTION - ACTION IN ASSUMPSIT PREVIOUSLY ASSIGNED TO: N/A COMPLAINT Plaintiff, Members I sl Federal Credit Union (Members 1 Sl), by its attorneys, Saidis, Shuff, Flower & Lindsay, P.c., files this Complaint demanding payment for outstanding amounts due under a farm-products loan, alleging in support thereof the following: 1. Members 1st is a credit union, organized and existing under the Federal Credit Union Act, with a principal office located at 5000 Louise Drive, Mechanicsburg, Pennsylvania 17055.. 2. Defendant Richard 1.. Neil is an adult individual having a last known address of 1065 Myerstown Road, South Middleton Township, Cumberland County, Pennsylvania 17324, 3. On or about February 6,2002, Defendant obtained a loan from Members 1S1 in the original principal amount of $35,502.39 (the "Loan"), as evidenced by a Motor Vehicle Installment Sale Contract (the "Contract"), a copy of which is attached hereto as Exhibit "A" and incorporated herein by reference. 4. Under the terms and conditions of the Contract, Defendant agreed to repay the principal balance of the Contract, together with interest at the annual percentage rate of 6.79% by way of regular monthly payments of principal and interest in the amount of $603.33 each, to commence on March 23, 2002, with the full outstanding balance of the Loan together with interest thereon due on or before February 23, 2008. 5. On or about March 7, 2003, Defendant entered into an Extension Agreement with Members I sl, a true and correct copy of which is attached hereto as Exhibit "B" and incorporated herein by reference. 6. Under the terms and conditions of the Extension Agreement, Defendant agreed to repay the principal balance of the Contract, together with interest at the annual percentage rate of 6.79% by way of regular monthly payments of principal and interest in the amount of$603.33 each, to commence on March 23, 2003, with the full outstanding balance of the Loan together with interest thereon due on or before July 23, 2008. 7. Defendant is in default of his obligation to make payment of the amounts due to Members I st under the Contract and under the Extension Agreement, for, inter alia, failure to make the monthly payments due Members I st under the terms and conditions of the Contract and Extension Agreement. 8. Notice of the default, repossession of the motor vehicle which was the subject of the Contract, and demand and opportunity to cure the same, required under the Uniform Commercial Code, were provided to the Defendant on or about November 26, 2003, a copy of which is attached hereto as Exhibit "c" and incorporated herein by reference. 9. As a result of Defendant's defaults, Members I sl exercised its rights and remedies under the Contract, the Extension Agreement, and the UCC and disposed of the repossessed motor vehicle, and on February 6, 2004, notified the Defendant of its disposition, and demanded immediate payment of all of the remaining amounts due under the Contract and Extension Agreement, a copy of which is attached hereto as Exhibit "D" and incorporate herein by reference. 10. The amount due to Members 1st under the Contract and Extension Agreement as a result of Defendant's defaults as of September 3, 2004, is $14,371.20 itemized as follows: a. Principal $ 13,030.12 b. Interest as of September 3, 2004 $ 506.61 plus $2.42 per diem c. Late Charges as of September 3 $ 84.47 plus $12.07 per month d. Attorneys' Fees and Costs $ 750.00 e. Total Due $ 14,371.20 11. Defendant also agreed under the terms of the Contract and Extension Agreement that in the event of default thereunder Defendant would pay, in addition to the charges listed in paragraph 10 above, all reasonable costs, fees and expenses incurred by Members I st as a result of the institution of these legal proceedings. 12. Despite Plaintiff's demands, Defendant has failed and continues to fail to make payments of all amounts due to Members I st under the terms and conditions of the Contract and Extension Agreement. WHEREFORE, Plaintiff, Members I st Federal Credit Union, demands judgment against Defendant, Richard 1.. Neil, in the amount of $14,371.20, plus interest at the rate of $2.42 per day, from September 4, 2004, through the date of Judgment entered hereon and thereafter through the date of payment, including on and after the date of entry of judgment on this Complaint, and legal fees and costs, which amount in controversy is required to be referred to arbitration.
