Garretson, husband and wife, of Aspers, Pennsylvania, are about to execute contemporaneously herewith, a contract with Mountain Homeworks, Inc., for the construction of a home upon a lot of land situate in Cooke Township, Pennsylvania, more particularly bounded and described in a deed from CharlotteYost Hunt, Successor Trustee of the John G. Heacock, Jr. Revocable Trust, to Frederick A Garretson recorded in Instrument No. 201128326, and being the same which Frederick M. Garretson and Cynthia D. Garretson, husband and wife, to Frederick A Garretson and Cynthia D. Garretson, husband, intended to be recorded herewith in the Office of the Recorder of Deeds of Cumberland County, and identified as 729 High Mountain Road, Gardners, Pennsylvania. NOW, ----,240 , 2012, at the time of and immediately before the execution of - Z;?? the principal contract, an before any authority has been given by the said Mountain Homeworks, Inc. to the said Mountain Homeworks, Inc., to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Mountain Homeworks, Inc., and the further consideration of One Dollar, to Mountain Homeworks, Inc., paid by Frederick M. Garretson and Cynthia D. Garretson, it is agreed that no lien shall be filed against the building and/or land by the contractor, or any subcontractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. The undersigned warrant that no material or supplies have been delivered to the site and no labor or services performed at the site in furtherance of said contract. Sol 729 High Mountain Road, Gardners, Cumberland County, Tax Map 07-14-0161-011 (10.1730 acres) ALL that certain lot or parcel of land, situate, lying and being in the Township of Cooke, County of Cumberland, State of Pennsylvania, (mountain land), and more particularly bounded and described as follows: BEGINNING at a point in High Mountain Road (T-335) at lands now or formerly of Gregory A. and Heidi Engstler; thence in High Mountain Road North 82 degrees 21 minutes 44 seconds West 265.01 feet to a point; thence continuing along same North 50 degrees 05 minutes 50 seconds West, 500.05 feet to an iron pin; thence continuing along same North 37 degrees 22 minutes 25 seconds West, 399.55 feet to an iron pin at lands now or formerly of Terry E. and Mary L. Straup; thence along lands of Straup through a setback iron pin 20.33 feet from the beginning of this course North 71 degrees 35 minutes 30 seconds East 757.47 feet to an iron pin at lands now or formerly of Mark D. Williams; thence along lands of Williams through a reference iron pin set back 21.27 feet from the end of this course South 10 degrees 33 minutes 20 seconds East, 928.43 feet to a point in High Mountain Road and land of Gregory A. and Heidi Engstler, the place of BEGINNING. The above description was taken from a Property Survey Plan prepared for Terry E. Straup, dated September 1, 2011, by Eric L. Diffenbaugh, a Professional Land Surveyor as attached to the deed in Instrument Number 201128326. BEING the same tract of land which Charlotte Yost Hunt, Successor Trustee of the John G. Heacock, Jr. Revocable Trust, by deed dated October 4, 2011, and recorded in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania, in Instrument Number 201128326, sold and conveyed unto Frederick M. Garretson; and the same which Frederick M. Garretson and Cynthia D. Garretson, husband and wife, by their deed dated the 'f day of July, 2012, and intended to be recorded herewith in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania, sold unto Frederick M. Garretson and Cynthia D. Garretson, husband and wife, the Mortgagors herein.
