STIPULATION AGAINST LIENS
THIS AGREEMENT, made the -10 of July, 2012, by and between
DRB, Inc. d/b/a Superior Homes. ,

whereby the former undertook and agreed to erect and construct a single family
residence on that certain lot of ground known as:
Lot #2 Roxbury Road, 371 Roxbury Road, Newville, Lower Mifflin Township,
Cumberland County, Pennsylvania
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of One and 00/100 Dollar ($1.00) to
Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the
further consideration mentioned in the agreement aforesaid, for themselves and their
subcontractors, and all parties acting through or under them, covenant and agree that
no mechanic's liens or claims shall be filed or maintained by them or any of them
against the said buildings and the lot of ground appurtenant thereto for or on account of
any work done or materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and construction of the said buildings
on the lot above described, and the said Contractor, for themselves, their
subcontractors and others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims against the said buildings or
any of them, and agree that this instrument, waiving the right of lien, shall be an
independent covenant.

ALL of the following tract of land being accessed by a private right-of-way that extenc
to SR 0997 (Roxbury Road) and being situated in Lower Mifflin Township, Cumberlar
County, Pennsylvania pursuant to the aforementioned final subdivision plan by Eric I
Diffenbaugh, PLS dated February 29, 2012 and recorded on June 5, 2012 at Instrument
No. 201216678.
BEGINNING at a set iron pin at the northeastern corner of Lot 2, thence along the
remnants of a fence line and along lands now or formerly of Ernest R. Beatty Jr. South
16 degrees 30 minutes 00 seconds West, 172.76 feet to a set iron pin, thence along land
now or formerly of Ray J., Patricia R. & Dale A. Lehman, Denise L. Garman, & Debora.
R. Waltemyer North 70 degrees 20 minutes 55 seconds West, 316.48 feet to a set iron pi
at the terminus of a 50-foot private right-of-way, thence along said right-of-way and b,
lands of Lehman, Garman and Waltemyer North 16 degrees 30 minutes 00 seconds Eall
172.76 feet to a set iron pin, thence continuing along lands of Lehman, Garman and
Waltemyer South 70 degrees 20 minutes 55 seconds East, 316.48 feet to a set iron pin,
said pin being the POINT OF BEGINNING.
BEING known as Lot No. 2 and containing 1.2533 acres.
