described below, has or is about to execute a contract with CUMBERLAND DESIGN & BUILDING COMP
whose principal business address is 760 CLAREMONT ROAD CARLISLE PA 17013 , to con:
commercial building upon lands situate at 5128 SIMPSON FERRY ROAD (LOT A1), MECHANICS
CUMBERLAND COUNTY, PENNSYLVANIA, and more particularly bounded and described on Exhil
attached hereto and made a part hereof; and,

NOW, THEREFORE, this day of , 2012, before any authority had been gii
CUMBERLAND DESIGN & BUILDING COMPANY to commence work on said facilities, or pt
materials for same, in consideration of making of the above-described Contract with WILLIAM W. WERT
AND PATRICIA J. WERZYN, Owner, and in further consideration of One ($1.00) Dollar paid to the
contractor by WILLIAM W. WERZYN, JR. AND PATRICIA J. WERZYN, Owner, the receipt whereof is
acknowledged, it is agreed that no liens or claims shall be filed or maintained against the Owner's facilit
the land above-described, or upon WILLIAM W. WERZYN, JR. AND PATRICIA J. WERZYN, the Owner
general contractor, or any of its subcontractors, or by any of the materialmen or workmen, or any other
acting through or under them, for or on account of any labor, or materials purchased, or extra labor or n-
purchased for, towards, in or about the erection, construction, design and improvement of said facilities
said contract or otherwise, the right to have, file and maintain such liens or claims against the facilities, t
above-described, and WILLIAM W. WERZYN, JR. AND PATRICIA J. WERZYN, the Owner, being
expressly waived by the general contractor for itself, its subcontractors, all materialmen, or workmen ar
acting through or under them.

EXHIBIT "A"
ALL THAT CERTAIN lot situate in Lower Allen Township, Cumberland County, Pennsylvania,
being identified and numbered as Lot Al, in accordance with the Plan entitled Fi al
Subdivision/Land Development Plan for West Shore Window and Door dated April 16, 2012
prepared by Akens Engineering Associates, Inc., and recorded on July 24, 2012 at Instrument
No. 201222111 in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania, being more fully bounded and described as follows, to wit:
BEGINNING at a point, said point being a concrete monument on the southern right of way line of
Simpson Ferry Road at the northwest corner of Lot 11 as recorded in Plan Book 74, Page 1;
thence progressing along said right of way line, North 78 degrees 42 minutes 50 seconds East, a
distance of 280.00 feet to an iron pin; thence progressing South 11 degrees 17 minutes 0
seconds East, a distance of 203.87 feet to an iron pin at the northern right of way line of Arthur
Avenue; thence progressing along said right of way line South 78 degrees 42 minutes 0
seconds West, a dsitance of 280.00 feet to a concrete monument; thence progressing North 11
degrees 17 minutes 10 seconds West, a distance of 203.87 feet to a concrete monument be g
