ANDERSON 90 Cherry Lane Carlisle, PA 17015 Defendant JURY TRIAL DEMANDED COMPLAINT NOW COMES, Plaintiff, Carolyn L. Stine, by her attorneys, Rhoads & Sinon LLP, hereby files the within Complaint, as follows: PARTIES 1. Plaintiff, Carolyn L. Stine, is an adult individual who resides at 11 Larch Enola, Cumberland County, Pennsylvania 17025. 2. Defendant, Barry L. Anderson , is an adult individual residing at 90 Cherry Carlisle, Cumberland County, Pennsylvania 17015. VENUE 3. Venue is proper in Cumberland County because the Plaintiff and Defendant in Cumberland County and the accident giving rise to this litigation occurred in Cumber County, Pennsylvania. Pa. R.Civ.P. 1006. FACTUAL BACKGROUND 4. On Wednesday, November 24, 2010, at approximately 12:35 p.m., Plaintiff L. Stine was operating her 2010 Honda Accord (hereafter "Stine vehicle"). The Stine vehicle lawfully exiting at the at the end of the ramp from I-81 south (Exit 49 off ramp) waiting to onto State Route 641 (Trindle Road). 5. Traveling behind the Stine vehicle was Defendant Barry L. Anderson. Anderson failed to observe the Stine vehicle and, because he was following the Stine vehicle closely and traveling at a speed that was too fast for conditions, struck the Stine vehicle from rear. 6. Defendant was cited by the Pennsylvania State Police for violating 75 Pa. Stat. § 3310, following too closely. 7. As a direct and proximate result of the impact, and the negligence, and recklessness of the Defendant as described herein, Plaintiff suffered injuries and damages a more fully set forth herein. COUNT I - NEGLIGENCE CAROLYN L. STINE V. BARRY L. ANDERSON 8. Plaintiff incorporates herein by reference paragraphs 1 through 7. 2 9. The negligence, carelessness and reckless disregard of Mr. Anderson consisted the following acts and omissions which are to be read in conjunction with paragraphs 1 throu 7: a. Failing to reduce his vehicle speed and/or increasing his speed as he approached the end of the merge ramp from Interstate 81 onto SR 641; - b. Operating his vehicle at a speed too fast for conditions; C. Failing to notice and observe Plaintiff's vehicle stopped at the end of the merge ramp; d. Following Ms. Stine's vehicle too closely; e. Failing to have his vehicle under proper and adequate control such that he could stop before striking the Plaintiff s car; f. Driving in a reckless and careless manner; g. Failing to keep alert and maintain a proper lookout for the presence of other motor vehicles including the Plaintiff's; h. Operating his motor vehicle too closely in violation of 75 Pa. Cons. Stat. § 3310; i. Failure to use appropriate and due care for the rights, safety and position of the Stine vehicle as it was lawfully stopped at the end of the merge ramp; j. Failing to drive around Plaintiff's vehicle instead of colliding with it; k. Failing to drive in such a manner that his vehicle could be brought to a stop immediately at the first sign of danger; 1. Failing to keep a proper lookout; M. Failing to operate a motor vehicle in such a fashion as to avoid striking the Plaintiff's vehicle; and 3 n. Driving in a reckless and careless manner with an extreme indifference of the interests of others by striking the Stine vehicle without attempting to slow down or apply the brakes. 10. As a direct and proximate result of the accident and the Defendant's conduct, Ms Stine suffered physical and personal injuries, all caused by the negligence and carelessness Defendant, including the following: a. cervical sprain; b. neck pain; C. shoulder pain d. headache; e. back pain; ff, blurred vision; g. numbness in left upper extremity; h. dizziness; i. intersegmental dysfunction of the cervical spine; j. intersegmental dysfunction of the thoracic spine; k. muscle spasm; 1. reversal of cervical curve at C5-C6, C6-C7; M. aggravation of degenerative disc disease; n. aggravation of bilateral sensory carpal tunnel syndrome; o. tremors, left side; P. continued pain and suffering. 11. As a direct and proximate result of the injuries described herein, Plaintiff Stine was required to restrict her normal work, recreational and household routines. 12. As a direct and proximate result of the injures described herein, Plaintiff Carolyn Stine suffered great pain and discomfort, sustained medical and other expenses, including loss earnings and future earnings, and was required to seek medical attention and undergo 4 therapy, all to her detriment and loss, which are claimed as damages herein, as well as all allowed by Pennsylvania law. 13. As a direct and proximate result of the injuries described herein, Plaintiff has unable to enjoy the usual activities of life of a physically active individual her age, and has a loss of enjoyment of life, loss of happiness, pain, suffering and emotional upset. 14. As a direct and proximate result of the injuries sustained, and the negligence of Defendant, Plaintiff is at risk for future medical complications and may, in the future, additional medical symptoms, expenses, losses and damages, including pain, suffering, upset and the loss of life's pleasures, which are claimed as damages, together with all other allowed by law. 15. Plaintiff elected the "full tort" option under her automobile insurance policy. WHEREFORE, Plaintiff demands judgment in her favor against Defendant for an. which exceeds the jurisdictional amount requiring arbitration pursuant to Pa.
