COMPLAINT FOR DECLARATOIJY JUDGMENT
Plaintiff Kegerreis Outdoor Advertising, LLC, by and through its attorneys McNees
Wallace & Nurick LLC, states as follows for its Complaint for Declaratory Judgment against
Defendant the Borough of Camp Hill:
The Parties
1. Plaintiff Kegerreis Outdoor Advertising, LLC ("Kegerreis") is a Pennsylvania
limited liability company with offices located at 1310 Lincoln Way East, Chambersburg,
Pennsylvania 17202.
2. Defendant the Borough of Camp Hill (the ',FBorough") is a body politic and
corporate of the Commonwealth of Pennsylvania located at 2145 Walnut Street, Camp Hill,
Pennsylvania 17011.
Factual Background
3. On February 17, 2009, Kegerreis submitted to the Borough an application for
a sign permit for the construction of an off-premises electronic billboard sign to be located at
1 Bishop Place, Camp Hill, Pennsylvania (the "Bishop Place Application").
4. On June 29, 2009, Kegerreis submitted to 'the Borough an application for a
sign permit for the construction of an off-premises electronic billboard sign to be located at
811 Spangler Road, Camp Hill, Pennsylvania (the "Spangler Road Application").
5. The Bishop Place Application and the Spangler Road Application each
described the sign to be constructed at the respective locations as a steel, single pole structure
containing two LED advertising panels, with each panel laving a panel face of 200 square
feet.
6. In response to the Bishop Place Application, the Borough issued Sign Permit
No. 3-2009 for the erection of the requested LED billboa?d sign at 1 Bishop Place, Camp
Hill, Pennsylvania (the "Bishop Place Sign").
7. In response to the Spangler Road Application, the Borough issued Sign Permit
No. 12-2009 for the erection of the requested LED billboard sign at 811 Spangler Road,
Camp Hill, Pennsylvania (the "Spangler Road Sign").
8. After the receipt of the sign permits, Kege?reis timely began construction of
the Bishop Place Sign and the Spangler Road Sign (collectively, the "Signs").
9. The Bishop Place Sign has been completely constructed.
10. The Spangler Road Sign is completely constructed except for one of the two
LED panel faces that is not yet installed.
11. On March 9, 2011, the Borough amended the Camp Hill Borough Ordinance
by amending Chapter 200, Article VII, Sections 200-43, 200-45 and 200-53 (Measurement
and Major Types of Signs) and Section 200-54 (Off-Premises Signs) (the "Ordinance
Amendments").

12. The Ordinance Amendments are unduly restrictive, particularly as to the
permitted hours that the Signs may be turned on ("Signs shall be turned off between one half
hour past sundown and one half hour before sunrise").
13. As a result of the Ordinance Amendments the Borough has taken the position
that the Signs are nonconforming signs under the Borough Ordinance.
14. A dispute has arisen between Kegerreis and the Borough as to whether
Kegerreis is required to comply with the Ordinance Amendments with respect to the Signs.
COUNT ONE
DECLARATORY JUDGMENT AS TO APPLICABILITY
OF ORDINANCE AMENDMENTS
15. Paragraphs 1 through 14 above are hereby 'incorporated by reference as
though fully set forth at length herein.
16. Section 7532 of the Declaratory Judgment Act, 42 Pa.C.S.A. § 7532, gives the
court the "power to declare rights, status and other legal relations whether or not further relief
is or could be claimed."
17. Pursuant to Section 7533 of the Declaratory Judgments Act, 42 Pa.C.S.A.
§ 7533, any person whose rights are affected by a statute or municipal ordinance may bring a
declaratory judgment action to have determined any question of construction or validity
arising thereunder.
M Kegerreis's rights are affected by the Borough's application of the Ordinance
Amendments to the Signs.
19. The issues in this case are ripe for judicial determination because an actual
case and controversy exists.

WHEREFORE, Kegerreis Outdoor Advertising, LLC requests that this Court declare
that the Ordinance Amendments enacted by the Borough' after the issuance by the Borough
Sign Permits to Kegerreis Outdoor Advertising, LLC have no applicability to the Signs and
cannot be enforced by the Borough as to the Signs.
