WITNESSETH: A. Owner owns an interest (Indicate either: Fee Simple or- Leasehold) in those certain premises known as Red Lobster #0195 4711 Carlisle Pike_, Mechanicsburg Pennsylvania (the "Property"), as more particularly described on Exhibit A attached hereto. B. The Owner has entered into a certain construction contract (the "Contract") with Ideal Company (the "Contractor") in connection with the erection, construction and completion of Red Lobster #0195 (the "Improvements") on the Property and construction is scheduled to commence on or about August 6 -2 012 . The total amount of said Contract is $ 415,373.00 , and the pertinent provisions of the Contract pertaining to the time or times for payment are attached hereto as Exhibit B. C. The Owner desires, by this instrument and the Contract referenced herein, to place all subcontractors and/or others with actual or potential mechanic's lien rights on notice of the total amount of said Contract and its provisions for the time or times for payment thereof. The Owner records this instrument and the attached pertinent provisions of the Contract attached as Exhibit B, for the purpose of availing itself of the protections provided for by 49 P.S. §1405; specifically, that where the claims of subcontractors exceed in the aggregate the unpaid balance of the Contract price, each claim shall, upon application of the Owner, be limited to its pro-rata share of the Contract price remaining unpaid, or which should have remained unpaid, whichever is greatest in amount at the time notice of intention to file a claim was first given to the Owner, such notice inuring to the benefit of all claimants.
