ORDER OF COURT
AND NO[nT, this 13th day of August, 2012, based
upon evidence received at a hearing held this date, the Court
finds by clear and convincing evidence that Russell Lee Zimmerman
is adjudged a totally incapacitated person.
The Court finds that Mr. Zimmerman suffers from
conditions or disabilities which totally impair his capacity to
receive and evaluate information effectively and to make and
communicate decisions regarding the management of his personal
affairs. Reverend Robert Graybill is appointed the emergency
guardian of the person of Russell Lee Zimmerman for the period of
72 hours and until such time as the Petitioner has filed a
permanent plenary petition for guardianship, said emergency
guardian appointment shall not exceed 30 days.
The emergency guardian is authorized to meet with
medical staff and Select Medical Care Ethics Commission.
However, if the recommendation is the withdraw of treatment and
palliative care, the Court will set another hearing for the Court
alone to make that decision based on evidence presented.
