The Plaintiff, CUMBERLAND MASONRY, INC., is a Pennsylvania corporation engaged in the business of concrete and masonry construction, excavation, and sales of concrete products with a principal place of business at 324 Market Street, Lemoyne, Pennsylvania 17043. 2. The Defendants, MARK DORWARD and DARINDA SUE DORWARD, are adult individuals who are husband and wife, and who reside or have a principal place of business at 505 South Third Street, Lemoyne, Pennsylvania 17043. 3. Upon information and belief, the actions of Defendant Mark Dorward as hereinafter set forth were undertaken as part of business activity conducted jointly by the Defendants, and from which both Defendants benefit. 4. In the fall of 2011, Defendant Mark Dorward made arrang4ments to purchase tiles from the Plaintiff. 5. The price of the tiles was $1,425.78. 6, The Plaintiff anticipated that Mr. Dorward would pick up the tiles during customary business hours and pay for them, but instead, he picked up the tiles, which were stockpiled outdoors, after hours, without paying for them. 7. Plaintiff has made a demand for payment, but despite the passage of a reasonable time for payment, and despite demand, the Defendants have failed and refused to make any payment whatsoever on the account. 8. Plaintiff has expended the sum of $122.72 in magisterial district justice costs in the pursuit of collection of this matter. WHEREFORE, Plaintiff requests your Honorable Court to enter judgment in its favor in the amount of $1,548.50, with interest and the costs of suit.
