(c) Twenty-five percent (25%) as follows: (i) 1/8 to the Bethesda Mission, Harrisburg, Pennsylvania; (ii) 1/8 to the Christians for Jews Foundation, San Antonio, Texas; (iii)1/8 to the Childrens' Hunger Relief Fund, Washington, D.C.; (iv)1/8 to the American Bible Society, New York, New York; (v) 1/8 to the American Red Cross, Harrisburg, Pennsylvania; (vi)1/4 to the Trinity United Methodist Church, New Cumberland, Pennsylvania; and (vii)1/8 to my sister, Tabea Weller, currently of Philadelphia, Pennsylvania, if and only if she survives me by a period of thirty (30) calendar days. If my sister does not survive me by a period of thirty (30) calendar days, I direct that her portion of my estate be divided proportionately among the charities named in this Item SECOND (c) according to the their interests therein;" and WHEREAS, Ruth Marz did not survive Ruth O. Wassell; and WHEREAS, Ruth Marz was survived by her three children, Manfred Marz, Alfred Marz and Christa Brunssen; and WHEREAS, Tabea Weller did not survive Ruth O. Wassell; and WHEREAS, Christians for Jews Foundation is correctly known as CJF Ministries; and ~~ WHEREAS, it is the desire of the parties hereto that distribution of the residuary bequests be made without the formality of the filing of an accounting in any court having jurisdiction; and WHEREAS, Fulton Bank, N.A. is willing to make such distribution upon receipt of the release and indemnification provided for in this Agreement. NOW THEREFORE, KNOW ALL BY THESE PRESENTS, that the undersigned does hereby request Fulton Bank, N.A. to make distribution of one/twenty-eighths (1/28) of the residue to the undersigned in the amount of Eleven Thousand Nine Hundred and Five Dollars and Twenty Cents ($11,905.20) pursuant to the attached First and Final Account of the Estate of Ruth O. Wassell, without the filing of the accounting for audit and approval by the court having jurisdiction. The undersigned, in consideration of the final distribution of residue, which is hereby acknowledged, for CJF Ministries, 'its successors and assigns, does remise, release, quit-claim and forever discharge Fulton Bank, N.A., individually and as Executor aforesaid, its successors and assigns, of and from all actions, suits, payments, accounts, claims and demands whatsoever or by reason thereof, and from any suit, payment, claim or liability arising from this final distribution of the residue of the estate.
