Worley, deceased Defe4dants NO.: 12- S2 CIVIL TERM CIVIL ACTION - QUIET TITLE COMPLAINT ANDI NOW COME the Plaintiffs, Francis Worley, Jr. and Daniel T. Worley by and through their attorney, Richard P. Mislitsky, Esquire, and bring forth this Complaint, and do respectfully represent thel following: 1. Plaintiff, Francis Worley, Jr. is an adult individual residing at 709 Coolidge Street, New Cumberland, Cumberland County, Pennsylvania. 2. Plaintiff, Daniel T. Worley is an adult individual residing at 178 Plank Road, York Springs, Adams County, Pennsylvania, and the brother of Plaintiff, Francis Worley, Jr. 3. Defgndants, if any, are Unknown Heirs, successors, assigns and all persons claiming right, title, or interest from, or under David Greist (also spelled Griest) or I.D. Worley (Isaac D.), deceased are ai class whose identity and addresses are unknown to Plaintiffs at this time. 4. Plaintiffs, Francis Worley, Jr. and Daniel T. Worley are the owners as tenants in common of property located primarily in South Middleton Township, Cumberland County, partly in 1 Latimore Township, Adams County, and partly in Franklin Township, York County, described as follows: BEGINNING at a stone pile in Franklin Township, York County, on the north side of County Line Road, and property of Clark Wagner; thence by said Clark Wagner and crossing said road into Adams County; south two degrees West forty-four and five tenths perches to stones; thence by lands now or late of Barry Weaver, North fifty-six West twenty-one perches more or less to a post; thence by lands of Charles M. Fogerty due north forty and nine tenths perches more or less to place of BEGINNING. CONTAINING five acres more or less. 5. The property is numbered 2810 County Line Road. 6. The herein described property is vacant mountain land. 7. The, last known owner of the land was I.D. Worley, the great-grandfather of the Plaintiffs' father, as shown on an adjoining deed, recorded May 26, 1958. A copy of the adjoining deed is attached hereto and identified as Exhibit A. 8. Based on his relationship to I.D. Worley, Francis Worley, the father of the Plaintiffs herein, prepared a deed transferring the land into his name. A copy is attached hereto and identified as Exhibit B. 9. The Deed was recorded in Adams County on January 28, 2000 in Deed Book 1996 at page 27. (see Exhibit B). 10. Francis Worley hired a professional surveyor to survey the land and it was discovered that the majojrity of land was actually in Cumberland County, even though the land is taxed in Adams County. 11. Beginning on January 28, 2000, Francis Worley paid the taxes on the land and posted the property as notice to any perspective individuals having a claim to the property. 12. On May 8, 2003, Francis Worley passed away. 2 13. Letters Testamentary were granted to Francis Worley, Jr. and Daniel T. Worley on May 12, 2003 and indexed in the Adams County Register of Wills Office at Number 01-03-0182. (see second recital on Exhibit C). 14. Title to the herein described property was transferred to Francis Worley, Jr. and Daniel T. Wo4ey, Plaintiffs herein, by Executors Deed recorded in the Office of Recorder of Deeds of Adams County, Pennsylvania, on April 28, 2004 in Deed Book 3546, page 159. A copy of the Fiduciary Warranty Deed is attached hereto and identified as Exhibit C. An Executor's Deed was', also recorded in Cumberland County, in Deed Book 262, page 36. A copy is attached hereto and identified as Exhibit D. 15. A B#ingdown and Certification through Patricia A. Black Abstracting, which dated the chain of title Ito February 2, 2000, and found no adverse claims to the property. A copy is attached hereto and identified as Exhibit E. 16. An Action to Quiet Title pertaining to the subject land was previously filed in Cumberland County and docketed as 05-4789 CIVIL ACTION - QUIET TITLE. 17. Said' Action was contested by two known heirs of I.D. Worley, specifically, Melvin S. Worley, and Mary Worley Wolfe and her husband, Arthur S. Wolfe. 18. As successors/heirs of Arthur S. Wolfe and his wife Mary Worley Wolfe, the interest in the subject property was vested in the Estate of Mary Worley Wolfe. 19. The aforesaid Action to Quiet Title has been resolved amicably. 20. The known heirs of I.D. Worley, Melvin S. Worley and the Estate of Mary C. Wolfe, have executed quit claim deeds conferring their interest in the land to the Plaintiffs. 21. Said (Quit Claim Deed was filed in Adams County and recorded at BK5313, p.18 on December 15, 2008 (Exhibit F). 3 22. The same deed was also filed in Cumberland County on January 13, 2009 (see last page of Exhibit F). 23. A title research report was completed by Adams Abstract Associates, Inc. dated September 30, 20110. A copy is attached hereto and identified as Exhibit G. 24. Adams Abstract Associates, Inc. provided revisions to Exhibit F on or about November 7, 20111. A copy is attached hereto and identified as Exhibit H. 25. Since the property is located in three counties - Cumberland, Adams, and York, each county was searched as well as patent records. (See Exhibit G). 26. The tract in question was part of a tract conveyed unto David Greist by Patent Deed dated November 2, 1827. (See Exhibit G, Item 2 - Patent Records - Harrisburg, PA). 27. There are no recorded conveyances from David Greist. 28. Estate records and ancient tax records were searched in all three counties, but no records of the tract were found. (see Exhibit G). 29. A reference on the deed dated 1840 refers to Jacob Griest having an ownership interest in the tract conveyed by Patent Deed dated November 2, 1827. (see Exhibit H, item 13). 30. The wife of I.D. Worley was the daughter of Jacob Griest, therefore, it is inferred that the property was transferred by unrecorded deed to I.D. Worley. (see Exhibit G, items 3, 5, 8, 16). 31. No (conveyances or outsales from I.D. Worley were found. (see Exhibit G, items 4, 9, 17). 32. It is necessary to confirm title to the property through this action to quiet title because of the unknown class of heirs. 33. This action is being brought in Cumberland County because the majority of the property is situated in Cumberland County. 4 34. Plaintiffs herein have contemporaneously filed a Motion for Service of Process by Publication pursuant to Pa. R.C.P. 430. 35. If approved, the Order attached to said Motion calls for publication in the counties of Adams, Cumberland and York. Following is a description of the research work performed and the results: PATENT REORDS - HARRISBURG, PA. 1. The caption tract was conveyed unto David Greist by Patent Deed recorded in the Archives at the Museum Commission on November 2, 1827. A copy of said Patent Deed is included herewith. Also included is a protraction of the Patent Deed containing 258.809 Acres with an overlay of the possible location of the caption tract. Note that the old Patent Deed protracts almost perfectly, but caption tract does not protract precisely. Therefore the metes and bounds do not match exactly, but it seems a good possibility that the location is close. 2. We searched the Patent Indicies from 1743 through 1961 looking for other conveyances into David or Jacob Griest or Greist and found no other conveyances of record. Copies of the indices are attached for your records. ADAMS COi NTY, PENNSYLVANIA We ch1ained the title back to Record Book 1996 page 27 wherein Francis Worley conveyed premises unto Francis Worle, dated 1/28/2000, and recorded 2/2/2000. Wolfe, deceased estate to Francis Worley, Jr., et al dated Dec. 15, 2008 and recorded in the office of the Recorder of Deeds of Adams County, Pennsylvania in Record Book 5313 at page 20. As we worked our way back we determined that based on the record and information provided by clients, that probably: 1. Caption tract was a part of Patent Deed dated November 2, 1987; 2. We searched David Greist or Griest and Jacob Greist or Griest from 1800 to present in Adams Counties and found no items of record. 3. Asper your information Carolyn Worley was the daughter of Jacob Griest (who was sometimes referred to as David Griest ',on Patent Deed) and married to Isaac Deardorff Worley (a/k/a I. D. Worley). We searched the indices for Carolyn Worley in Adams County and found no items of record. 4. We searched the indices for I. D. (Isaac) Worley in Adams County and no outsales or conveyances to or from I. D. Worley were found. We searched Adams County from 1888 to present. 5. Carolyn Griest Worley and I. D. (Isaac) Worley had a son, Willis Worley. We don't know if they had any other children. We searched the indices in Adams County and no outsales were found. We found no estate for Willis Worley. 6. Willis !Worley had a child-Chester Worley. Chester Worley had 3 children (Francis Worley, Melvin Worley and Mary C Worley Wolfe). We searched the indices in Adams County for the three children and found no outsales (other than mentioned above) that pertained to this caption tract. We did, however, find Estates as follows: a. Carol n Worley was the daughter of Jacob Griest (who was sometimes referred to as David Griest on Patent Deed) ,nd married to Isaac Deardorff Worley (a/k/a I. D. Worley). We searched the indices for Carolyn Worley in York County and found no items of record. 9. We searched the indices for 1. D. (Isaac) Worley in York County and no outsales or conveyances to or from I. D. Worley were found. We searched York County from 1749 to present. 10. Carolyn Griest Worley and I. D. (Isaac) Worley had a son, Willis Worley. We searched the indices in York County and no outsales were found. We found no estate for Willis Worley in any of the three counties searched. 11. Willis Worley had 3 children (Chester Worley, Melvin Worley and Mary C Worley Wolfe). We searched the indices in all three counties under the above three children and found no outsales that pertained to this caption tract. We searched the Fogarty tract back to 10/17/28 (Estate of Jean Bosler Chamberlein). Deed Book 214 page 1146 states premises were not assessed. Recently found to be in Cumberland County. We ran Fogarty back ,gag L until I/18/3A94when chain was lost. The current deed of Fogarty tract in Record Book 260 page 3690 recites as "being corner of Francis Worley Estate". That is the only mention of Worley property in Fogarty Chain. The Fogarty Chain',recites drawing 03-073 filed 5/12/02, unrecorded and a survey dated 3/22/96 by Act I Consultants which is also unrecorded. 13. While (researching the Fogary tract, we found an old deed dated March 20, 1840 and recorded in Cumberland County Record Book H-3 page 345 wherein it states in the recital that was " held from Jacob Griest a deed Feb. 1 1, 1828 who held the same together with other of which this is a part by of a Patent deed bearing date November 1827 which recital of title refers." A copy of this deed is attached hereto, but is very difficult to read. We found no record of exceptions to or from the Fogarty Tract upon the Worley lot. 14. We searched adjoining property owners in York County until the chains were lost in the 1800s. No legal descriptions indicated being located adjacent to lands of I. D. Worley or any of the parties we propose were owners through the years other than the Fogarty tract. We searched the Ancient Assessment Records in York County and the only record of assessment was found in Adams County which is only from the year 2000 to present. CUMBERLAND COUNTY 15. Contemporaneous with the filing of this Motion, Plaintiffs by and through counsel, filed a Complaint in an Action to Quiet Title. 2. The Defendants in said Quite Title Action are: - Any unknown heirs of David Greist, deceased and - Any unknown heirs of I.D. Worley, deceased 3. David Greist (a/k/a David Griest) was granted a Patent Deed on November 2, 1827. The descendants of David Greist are unknown. 4. The father of the Plaintiffs herein, Francis Worley, was a descendant of Carolyn Griest Worley and I.D. Worley. 1 5. Plaintiffs' father acquired title to the subject premises by deed recorded in Adams County in Deed Book 1996, page 27, filed on January 28, 2000 (Exhibit A, attached hereto). 6. In addition to the Plaintiffs herein, the descendants of Francis Worley include Melvin S. Worley and the Estate of Mary C. Wolfe. 7. The interests in the subject property held by Melvin S. Worley and the Estate of Mary C. Wolfe were purchased by Plaintiffs. 8. Aj Fiduciary Deed transferring their respective interests of Melvin S. Worley and the Estate of Mary C. Wolfe to Plaintiffs was filed in Adams County and recorded at BK 5313, p.18 (Exhibit B, attached hereto). 9. The same Fiduciary Deed transferring their respective interests to Plaintiffs was also filed in Cumberland County on January 13, 2009 (See last page of Exhibit B). 10. Title searches were performed and reported by dates February 2, 2000 and September 30, 2011, as amended by report dated November 7, 2011. 11. Said title reports identified no other specific individuals having an interest in the subject property other than the Plaintiffs. 12. Plaintiffs aver that there are no known persons with an interest in the subject property, and service of process cannot be made by any other method than service by publication. 13. Because the subject property is primarily situate in Cumberland County, but taxed in Adams County, Plaintiffs intend, if approved by this Honorable Court, to place notices in the York Dispatch, the Carlisle Sentinel, the Gettysburg Times, and the law journals of the three counties. 14.
