NO. 12 - CIVIL TERM ADITYA CHUGH, Defendant COMPLAINT AND NOW, comes Plaintiff Dickinson College by and through its attorneys, MART50N DEARDORFF WILLIAMS OTTO GILROY & FALLER, and hereby avers as follows: 1. Plaintiff Dickinson College is a Pennsylvania educational institution and nonpirofit corporation with its principal place of business at West Street, Post Office Box 1773, Carlisle, Cumberland County, Pennsylvania 17013. 2. Defendant Aditya Chugh (hereinafter "Student") is an adult individual whose last known address is 330 East 38`h Street, Apt. 39-F-E, New York, NY 10016-2759. 3 . On or about January 31, 2001, Student entered into the Abe and Cora Hurwitz Student Loan (Loan # 1) with Dickinson for the financing of $2,500.00. A copy of Loan # 1 is attached hereto as Exhibit "A." -1. On or about February 20, 2001, Student entered into the Abe and Cora Hurwitz Student Loan (Loan #2) with Dickinson for the financing of $250.00. A copy of Loan #2 is attached hereto as Exhibit "B." 5. On or about July 16, 2001, Student entered into the Abe and Cora Hurwitz Student Loan (Loan #3) with Dickinson for the financing of $6,000.00. A copy of Loan #3 is attached hereto as Exhibit "C." y 6. On or about November 5, 2001, Student entered into the Abe and Cora Hurwitz Student Loan (Loan #4) with Dickinson for the financing of $2,000.00. A copy of Loan #4 is attached hereto as Exhibit "D." 7. On or about March 27, 2002, Student entered into the Abe and Cora Hurwitz Student Loan (Loan #5) with Dickinson for the financing of $500.00. A copy of Loan #5 is attached hereto as Exhibit "E." 8. On or about June 28, 2002, Student entered into the Abe and Cora Hurwitz Stuv=lent Loan (Loan #6) with Dickinson for the financing of $2,000.00. A copy of Loan #6 is attached heireto as Exhibit "F." 9. On or about August 20, 2002, Student entered into the Abe and Cora Hurwitz Student Loan (Loan #7) with Dickinson for the financing of $10,000.00. A copy of Loan #7 is attached hereto as Exhibit "G." 10. On or about September 10, 2003, Student entered into the Abe and Cora Hurwitz Student Loan (Loan #8) with Dickinson for the financing of $6,000.00. A copy of Loan ~8 is attached hereto as Exhibit "H." Exhibits "A" through "H" shall be collectively referred to herein as the "Contracts" COUNTI BREACH OF CONTRACT 11. Plaintiff hereby incorporates by reference the averments contained in Paragraphs 1 through 10 of this Complaint. 12. Plaintiff has fulfilled, performed and complied with all obligations and conditions of the Contracts. 13. Defendant breached the expressed and implied obligations, conditions and terms of the Contracts by failing to pay the amounts financed therein. WHEREFORE, Plaintiff demands judgment against the Defendant in the amount of $32,485.03, plus interest on each of the Contracts as set forth therein, attorney fees in the amount of $2,500.00 and costs accruing thereafter. I . ~ COUNT II IN QUANTUM MERUIT 14. Plaintiff hereby incorporates by reference the averments contained in paragraphs 1 through 17 of this Complaint. 1 Defendant is liable to the Plaintiff and/or has been unjustly enriched in the amounts as set forth in the Contracts. WHEREFORE, Plaintiff demands judgment against the Defendant in the amount of $32,485.03, plus interest on each of the Contracts as set forth therein, attorney fees in the am©unt of $2,500.00 and costs accruing thereafter. T ABE AND CORA HURWITZ STUDENT LOAN DICHINSON COLLEGE CARLISLE, PENNSYLVANIA. 17013-2896 Date: January 31, 2001 I, Aditya Chugh, hereby acknowledge receipt from Dickinson College, the "College", of a Hurwitz Student Loan in the principal amount of $2,500.00 (Two Thousand Five Hundred Dollarg), which is hereby applied on my College account for the 2000-2001 academic year. I agree to repay the College according to the following plan: L Interest Interest shall accrue on the outstanding principal balance from the first day of the month following the mornh in which I graduate or cease to matriculate at the College, and shall be at the FIND ANNUAL PERCENTAGE RATE of 5.000 percent (5%). Interest shall accrue on a daily basis. TL Repaymen I promise to repay the principal and the interest, which accrues thereon commencing six months after the date I graduate or cease to matriculate at the College. I will repay in equal momhpy installments with a minimum monthly payment of $40.00 (which includes both principal and interest), and a maximum repayment period of ten (10) years (120 months). The College may, at its option, grant an ddditional deferment period of up to four (4) years for full-time study after a student leaves, Dickinsmn College. III. Default I shall have been deemed to have committed. an "Event of Default" of this Contract upon the occurrence of any of the following: • failure to make any payment on or before the date it is due, • failure to make a payment on any other Comract outstanding with the College, • failure to perform any other provision of this Contract, ~ • I provide the College with false information or signatures, • my death, incompetence, or conviction of any crime involving fraud or dishonesty, insolvency or bankruptcy. Upon or after the occurrence of any Evern of Default, the College will provide me with notice, by certified mail as required by law, addressed to my last known address as shown on the College recorde, advising me of the default and of my right to cure the default. The notice will provide the time, amouirt and performance necessary to cure the default. If I do not cure the default as provided in the notice, ttpe College's rights include the right to declare all sums due on this contract to be immediately due and payable, as well as any other rights the college may have at loss as in equity. I understand that if I default on my loan repaymern, the College may disclose that I have defaulted, along with other relevant information, to credit bureau organizations. i _ IV. Penalty Charge If I fail to make timely paymern of all or any part of a scheduled installment, I promise to pay the charge assessed against me by the College. No charge may exceed $1.00 for the first month or part of a month by which, the installment is late, and $2.00 for each month or part of a month thereafter. I promise to pay all attorney fees and other reasonable collection costs and charges necessary for the collection of any amount not paid when due. V.
