MUNICIPAL LIEN FOR SEWER/WATER RATES ~
NOW COMES the Borough of Mechanicsburg Cumberland County,
Pennsylvania, by its attorney Lisa Marie Coyne, Esquire, and files the within claim
for charges assessed with respect to sewer and /or refuse rates against above
named owner or owners and against the hereinafter described real estate as
follows:
STATEMENT OF CLAIM
1. This claim is filed by the Borough of Mechanicsburg, a borough organized
and existing in accordance with the laws of the Commonwealth of
Pennsylvania.
2. The owner or reputed owner of the property, or party or parties
responsible or liable, for which this claim is filed is the Defendant(s).
3. The authority under which the sewer and/or refuse rates were changed
and assessed is the Act of July 18, 1935, P.L. 1286, Section 1, 53 P.S. § 2231,
as amended.
4. Plaintiff has made demands for payment for services; however,
Defendant(s) have not made payments for the services provided.
5. The authority under which this claim is filed is the Act of May 16, 1923 ,,~~ii

6. A description of the property against which this claim is filed is:

7. This claim has not been the subject of any previous claim and judgment
in the Court of Common Pleas of Cumberland County for sewer and/or
refuse charges.
8. The total amount of the charges for which this claim is filed is
eight hundred and eighty two and 50/100 dollars ($882.50), plus costs and
reasonable attorney's fees.
9. The time period for which these charges are filed is October 1, 2011 to
September 30, 2012 on Sewer/Refuse Account 4161-0.
WHEREFORE, Claimant requests that a Municipal Lien be entered in its
favor and against the Defendant in the amount of eight hundred and eighty two
and 50/100 dollars ($882.50), plus cost and reasonable attorney's fees.

land formerly of Anna M. Zimmerman, now of John E. Rakestraw; thence
northwardly along said line, two hundred and sixteen (216) feet, to 'a
point on the southern line of a fourteen foot passage way; thence
eastwardly along the line of said passage way, fifty 150) feet to a
point, corner of the line of lot formerly of the aforesaid Jonas B.
Zimmerman, now Irva Zimmerman; thence eouthwardly along the line of
lot formerly of said Jonas B. Zimmerman, now Irva Zimmerman, two
hundred and sixteen (216) feet to the curb line of said Weat Main
Street, the place of HEGINNING.
HAVING thereop erected a two story, brick house known as No. 518 WeNt
Main Street.
SUBJECT, NEVERTHELESS, to the condition and reservation that the said
parties of the second part, their heirs, executors, administrators ar
assigns, shall not build, or cause or allow any one else to build,

within twenty-three (23) feet of the curb line of said lot on said ,
bleat Main Street.
BEING the same premises which Margaret 2. Konhaua and Dorothy Z.
Miller, Executrices under the Last Will and Testament of Alice E.
Zimmerman, deceased, by their deed dated October 21, 1963, and record*
ed in the Office of the Recorder of Deeds of Cumberland County in Deec9
Book A-21, Page 61, granted and conveyed unto William H. Stewart and
Sara R. Stewart, hie wife. The said William H. Stewart died April 17,
1976, whereby title vested in Sara R. Stewart; Grantor herein, by
operation of law.
AND the said Grantor hereby covenants and agrees that she will
warrant specially the property hereby conveyed.
