NOW, THEREFOR, an consideration of the foregoing premises, tha covenants and
agr+cernents c~ntainexl in the Contracts, and intending W be legally bound hereby, the
Subcontractor, for itself and its successors and assigns, does hereby covenant, stipulate, promise
and agree as follows:
l . That no lien or right to file a liest or claim against the Work, SUSSI's interrest in
the Property, any improvements on the Property (eollesctively, the "Improvwtaatb„) err the
respective extates, rights, titles or interests of the Owners (collectively, "Intera~"), or any part
or parts thereof shall accrue or exist in the Subcontractor; that no mocha>lics' lien ctir claim or
materiaimen's lien or other lien or claim of any kind whatsoever shall be filetd or .maintained
against the Work, Pmpa~ty, Improvements or Interests or any part or parts thesrraf or the
apputtenanees thereto, by or in the name; of the Subeontracwr for work done or for any labor,
tools, exluipmextt, materials, supervision or other servicxs furnished by Subcontrtactort under the
Subcortract or any supplements or changes ther+eta, written err oral, far and about the' Work, the
Property, the Improvements or the Interests or any parts thp~cof, or on crradit thereof; rear shall
any claim or liability for such labor or materials or work perforrne+d arise, exist or be fiKexl against
any of the Owners, their respective successors {including, suaxussors in interest) or assigns by or
in the name of Subcontractor.
2. This Waiver of Liens shall be an independent coveatant which dull be binding on
Subcontractor, notwithataadang any breach or default under then Subcontract and shell c~pente
and be effective as well with re:pocK to work done and materials and services furai~had under
any suppled contract for extra work in oorwection with the Work. It is the full ir~ttettt of the
Subcontractor under this Waiver of liens and the Subcontract, fiat then right to file a ma~aaic's
lien or other claim, under the previsions of Acts of Assembly in such casex made and provided,
for work done or materials furnished in and about the erection, construction, denholation or
repairs of the Work, is foeever, absolutely and irrevocably hereby waived.
3. In ot+der to give the Owners fill} power and authority to protect thetnsieelve~, and
the Work, the Property, the Ianprovexnents and the Interests against any and all clattns by or
in the name of the Subcontractor in violation of the foregoing covenants, the SuboaaUracsar, for
itself, its successors gad assigns, her+~y irrevocably authorizes and empowers any sttvrney of
any Court of Common Plus of the Commonwealth of Pextnsylvania W appear for Sector,
in any such Court as Attoeney for Sube~ontracror, and in his or its name,-mark satisftecl'~,of record,
at the cost and expense of the Subcontrutor or ~ his yr its ate:, any and all rnecht~pics' kerns
or claims or materialmen's liens or claims or other liens or claims of any kind whatsoever filexl
or maintained against the; Work, the Property, the Improvements or the Interests or' any parts
thereof or flu appurteutances theresto, and far such act or acts this shall be good andlsuffieient
warrant and authority and a reference to the Court and to the docket in which and ~h?here this
instrument shall have been find dull be a sufficient rxhibat of the authority Iterrin cod to
wanuet such action, and the Subc:orttracxor does hereby rehuse all erras and defects whatsoever
in the entry of any such satisfaction or the exerea~ of the authority hereby eoeferr+ad. In the
event that any cant of canpetent jarisdaction dull de~mine that any provision of tlt6is Waiver
of Lams is void or uneaforoeabae in accordance with its germs, the Subooettlactor'e<xpressly
consents and agrees that this Waiver of Liexts may be modified by said Court auc~t that the
offending provision shall be of no furdter force and effcet, but the remainder of this Waiver of

Subcontractor and all parties claiming in the name of or on behalf of the Subcontractor.
4. THIS WAIVER 4F LIENS, at the election of the Uaru~rs. may be 'filed in the
office of the Prothonotary of Cumberland County, Pennsylvania, pursuant to the p~avisinns of
the Mechanic's Lien Law, and the receipt for such filuag will be delivered to the thlrrters. This
Waiver of Lams than be bitMdittg upaa the. Subcontractor. its succea+sors and assigns. land anyone
filing a mechanic's (ion or oti~er claim in the name of or for or on behalf of the Subernhtractor.
