Defendant CIVIL ACTION -LAW COMPLAINT AND NOW comes the Plaintiff, Americhoice Federal Credit Union, by and through its attorneys, the Dethlefs-Pykosh Law Group, LLC, by Darrell C. Dethlefs, Esquire who files this Complaint (the "Complaint") against Defendant, Wali T. Thomas, and hereby alleges as follow 1. Plaintiff is Americhoice Federal Credit Union, duly authorized to conduct business within the laws of the Commonwealth of Pennsylvania, having a principal place of business located at 20 Sporting Green Drive, Mechanicsburg, PA 17050. 2. Defendant, Wali T. Thomas, is an adult individual currently residing at 2284 Gleim Drive, Enola, PA 17025. 3. On or about March 26, 2012, Defendant applied for a signature loan from plaintiff. true and correct copy of Defendant's personal service application is attached hereto and incorporated by reference as Exhibit "A." The application attached as Exhibit A has personal data redacted. A none redacted copy is available and will be produced for the defendant. _ _ ~ 4. On or about March 27, 2012, Defendant signed the "Loanliner Loan and Security Agreement and Disclosure Statement". A true and correct copy of Defendant's "Loanliner Load and Security Agreement and Disclosure Statement" is attached hereto and incorporated by reference as Exhibit "B." The Plaintiff has redacted personal data from Exhibit B. A none redacted copy is available and will be produced for the defendant. COUNT I -BREACH OF CONTRACT 5. The averments contained in Paragraphs 1 through 5 above, are incorporated herein y reference thereto as though herein set forth at length. 6. Plaintiff agreed to extend a principal balance of five thousand fourty five dollars an seventy-one cents ($5,045.71) to Defendant. 7. The signature loan has an interest rate of 14.990%, as shown in the Loan!liner Loan and Security Agreement and Disclosure Statement in Exhibit "B," and is identified by loan ID .....0332. 8. Each month, pursuant to the terms and conditions of the Loanliner credit. agreement, Defendant was responsible for paying a monthly payment of one hundred thirty-twa dollars an eighteen cents ($132.18). 9. Defendant has not made a payment. 10. Defendant breached the terms and conditions of the agreement between xhe parties b failing to pay the balance due or make the required monthly payment. 11. The full balance due and owing to the Plaintiff on the aforementioned credit card account as through August 31, 2012 is $5,271.83. 12. Defendant has breached the terms of the Loanliner Loan and Security Agreement an Disclosure Statement. i 13. Although repeatedly requested to pay the principal balance and finance charges by Plaintiff, the Defendant has failed to do so to his detriment. 14. Pursuant to the Loanliner Loan and Security Agreement, the Plainiff is entitled to Collection Costs, which include "the cost of storing the Property, preparing it for sale and attorney's fees to the extent permitted under statE law or awarded under the Bankruptcy Code." Loanliner Loan and Security Agreement (Exhibit "B"), page 3, paragraph 9. WHEREFORE, Plaintiff, Americhoice Federal Credit Union demands judgment be entered against Defendant herein in the sum of $5,271.83 plus interest, attorney's fees, and cos s.
