Plaintiff is Orrstown Bank, a bank authorized to do business under the laws of the Commonwealth of Pennsylvania with an office at 2695 Philadelphia Avenue, Chambersburg, Pennsylvania, 17201. 2. Defendants are Robert L. Slagle and Susan D. Slagle, adult individuals last known to have an address at 8 Foxfield Court, Mechanicsburg, Cumberland County, Pennsylvania, 17050. 3. Defendants, Robert L. Slagle and Susan Slagle, are the real owners of the property located at 1261 Claremont Road, Carlisle, Pennsylvania, 17015. 4. On or about May 25, 2001, Defendants, Robert L. Slagle and Susan D. Slagle, executed a mortgage in favor of Plaintiff, Orrstown Bank, in the amount of One Million Fiffiy m6sn9 i Thousand Dollars ($1,050,000.00), which mortgage is recorded in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania, at Mortgage Book 1710, page 137 and recorded on May 25, 2001. A true and correct copy of the Mortgage is attached hereto as Exhibit "A". 5. The Mortgage secures real property located at 1261 Claremont Road, Carlisle, Pennsylvania as more particularly described in legal description attached to the Mortgage. 6. There have been no assignments of the Mortgage. 7. The Mortgage is in default by reason of, inter alia, the Defendants' failure to pay the monthly payment due for July 2012 and all subsequent montlily payments due on the note for which the Mortgage is collateral. 8. Robert and Susan Slagle were advised of the default under the Mortage and given an opportunity to cure. No cure has occurred. 9. Under the terms of the Mortgage, the entire unpaid balance is now due and payable together with other charges as follows: Principal Balance $ 672,018.46 Interest to 8/10/12 $ 3,229.18 (per diem $99.81) Termination and Satisfaction Fees $ 310.00 Attorneys' fees ~ 18.000.00 Total Due: $ 693,553.64 I p. The per diem interest on the underlying obligation is $70.00. 11. Notice pursuant to Section 403 of Act 6 of 1974, 41 P.S. §403, is not required in this matter since the principal amount of the Mortgage is in excess of Fifty Thousand Dollars ($50,000.00).
