Plaintiff is Orrstown Bank, a bank authorized to do business under the laws of the Commonwealth of Pennsylvania with an office at 2695 Philadelphia Avenue, Chambersburg, Pennsylvania, 17201. 2. Defendant is Robert Slagle, an adult individual last known to have an address at 8 Foxfield Court, Mechanicsburg, Cumberland County, Pennsylvania, 17050. 3. Defendant, Robert S1agIe, is the real owner of the property located at 419 East High Street, Carlisle, Pennsylvania, 17013. 4. On or about December 15, 1997, Defendant, Robert Slagle, executed a mortgage in favor of Plaintiff, Orrstown Bank, in the amount of Two Hundred Thousand Dollars ($200,000.00), which mortgage is recorded in the Office of the Recorder of Dceds of 9732098_3 Cumberland County, Fennsylvania, at Mortgage hook 1427 at Page 540 and recorded on January 29, 1998. A true and correct copy of the Mortgage is attached hereto as Exhibit "A". 5. On or about December 29, 2010 Robert L. Slagle executed a first amendment to mortgage in favor to the plaintit~, Orrstown Bank. The first amendment to mortgage is recorded as instrument number 201100003 on January 3, 2001 in the Office of the Recorder of Deeds of Cumberland County. A true and correct copy of the first amendment to mortgage is attached hereto as Exhibit B. The mortgage and first amendment to mortgage are collectively referred to herein as the "Mortgage." 6. The Mortgage secures real property located at 419 East high Street, Carlisle, Cumberland, PA as more particularly described in deed book S36, page 810. A true and correct copy of the description of the property subject to the Mortgage is attached hereto as Exhibit C. 7. There have been no assignments of the Mortgage. 8. The Mortgage is in default by reason of, inter alia, the Defendant's failure to pay the monthly payment due for July 2012 and all subsequent monthly payments due on the note for which the Mortgage is collateral. 9. Under the terms of the Mortgage, the entire unpaid balance is now due and payable together with other charges as follows: Principal Balance $ 168,838.01 Interest to 8/10/12 $ 2,230.18 (per diem $99.81) Late Charges $ 148.95 Termination and Satisfaction Fees $ 255.00 Attorneys' fees of 5% $ 8.OQ0.00 Total Due: $ 179,472.14 2 9732098 3 10. Notice pursuant to Section 403 of Act 6 of 1974, 41 P.S. §403, is not required in this matter since the principal amount of the Mortgage is in excess of Fifty Thousand Dollars ($SO,OOp.00) and this is a commercial mortgage. WHEREFORE, Plaintiff, Orrstown Bank, demands judgment in the sum of One Hundred Seventy Nine Thousand Four Hundred Seventy Two and 14/100 Dollars ($179,472.14) plus costs and for foreclosure and sale of the mortgaged premises.
