Plaintiff, CACH, LLC, by its attorney Allan C. Smith, Esq., by way of complaint against Defendant
GRAHAM ENTERPRISES, avers the following:
1. Plaintiff, CACH, LLC, is a Colorado limited liability company doing business at 4340 South
Monaco Street 2nd Floor, Denver, CO 80237.
1. Defendant, GRAHAM ENTERPRISES, is an business located at 215 W SIMPSON ST # 12,
MECHANICSBURG, PA 17055.
3. Plaintiff's cause of action is based upon a writing. <Exhibit C>
4. Defendants, GRAHAM ENTERPRISES, was indebted to First Equity Card Corporation for
a breach of a written contract by and between them in the amount of $21,587.27 which balance
was due and unpaid as of October 20, 2009, for credit card account number 4988820003513446.
<Exhibit A>
4. On or about September 10, 2010, First Equity Card Corporation sold the debt for good and
valuable consideration to plaintiff, CACH, LLC <Exhibit B>
5. The Defendants, GRAHAM ENTERPRISES, last tendered a payment on May 6, 2009.
6. A copy of the credit card agreement is attached hereto. <Exhibit C>
7. Plaintiff is entitled to charge-off account finance charges of $0.00. <Exhibit A>
8. Plaintiff is entitled to pre-litigation charge-off interest of $18.9199 per day from the default date
31.990°Io annual percentage rate x $21,587.27 / 365 days) or $18.9199x600 days = $11,351.95;
which is accrued interest through the date of filing. <Exhibit A> Plus an award of late fees 0.00,
court costs $203.75 and reasonable attorneys fees as stated in the Cardholder Agreement attached
hereto as <Exhibit C>.
9. The defendant, being indebted to the plaintiff upon the account by and between them did promise
to pay said sums upon demand. Demand has been made for payment and the defendants have
failed to remit payment.
WHEREFORE, plaintiff demands judgment against the defendants for $34,342.97 which includes
interest, court costs and a prayer to the court for reasonable attorney's fees in the amount of $ 1200.00
should this matter be contested or go to default judgment.
