MARTZ, Defendants :MORTGAGE FORECLOSURE COMPLAINT IN MORTGAGE FORECLOSURE Plaintiff, Integrity Bank, by and through its undersigned counsel, hereby files this Complai~t in Mortgage Foreclosure pursuant to Pa.R.C.P. No. 1141, et seq., and in support thereof avers the following: 1. Plaintiff, Integrity Bank, is a Pennsylvania banking institution with its principal place of business at 3314 Market Street, Camp Hill, Pennsylvania 17011. 2. Defendants, Robert S. Caudill and Wendy S. Martz, are adult individuals who were last known residing at 423 West Main Street, Mechanicsburg, Pennsylvania 17055. 3. This Court has jurisdiction over this matter this matter pursuant to 42 Pa.C.S.A. § 931(a). 4. This Court is the proper venue for this matter pursuant to 42 Pa.C.S.A. § 931(c) anti Pa.R.C.P. No. 11142 because the real property in question is located in Cumberland County, Pennsylvania. 5. On Apri120, 2011, Plaintiffmade a loan to the Defendants in the principal amount~of $219,900.00 (the "Loan"), and the Defendants executed and delivered to Plaintiff a Promissory Ndte in favor of the Bank dated Apri120, 2011 in the amount of $219,900.00 (the "Note"). Attached hereto as Exhibit A and incorporated herein by reference is a true and correct copy of the Note. 6. On April 20, 2011, to secure the payments due under the Note, Defendants executed and delivered to Plaintiff a mortgage (the "Mortgage") against certain real property located at 423 West Main Street, Mechanicsburg, Cumberland County, Pennsylvania (Parcel ID# 20-23-0567-027!) (the "Property"), which was recorded in the Cumberland County Recorder of Deeds Office on May, 9, 2011 in Instrument No. 201113360. Attached hereto as Exhibit B and incorporated herein by reference is a true and correct copy of the Mortgage. 7. The Defendants have defaulted on the Note and Mortgage by failing to make payments under the Note for a period in excess of four (4) months. 8. On August 1, 2012, Plaintiff sent Defendants a notice under Act 6 of 1974 (the "Act 6', Notice") advising them of the default and requesting immediate payment of the delinquent amount. Attached hereto as Exhibit C and incorporated herein by reference is a true and correct copy of the Act 6 Notice. 9. The amounts due under the Note have been accelerated as a result of the payment defaults by the Defendants and as of September 4, 2012, the amounts due and owing thereunder ar$ itemized as follows: Principal: $216,930.25 Interest $ 4,426.29 Satisfaction Fees $ 70.50 Late Fees $ 248.44 TOTAL: $221,675.48* *along with additional interest accruing after September 4, 2012 at the per diem rage of $32.30, costs and additional reasonable attorneys' fees for collection as allowed by law, until all sums are paid in full (the "Indebtedness"). 10. Judgment has not been entered on the Note or Mortgage in any jurisdiction. 11. The Note and Mortgage have not been assigned and are still held by Plaintiff. 12. Pursuant to Pa.R.C.P. No. 1019(h), this action is based upon a breach of the written Mortgage. i . 13. The Defendants are adult individuals over the age of eighteen (18) and are not subject to the protection of the provisions of the Servicemembers Civil Relief Act, f/k/a the Soldier's and Sailor's Civil Relief Act of 1940, 50 U.S.C. App. 501, et seq., as amended. 14. Plaintiff demands judgment against Defendants in mortgage foreclosure for the Indebtedness so Plaintiff may sell the Property in an attempt to satisfy the Indebtedness. WHEREFORE, Plaintiff demands judgment in mortgage foreclosure against Defendants, Robert S. Caudill and Wendy S. Martz, in the sum of $221,675.48 as of September 4, 2012, along with interest accruing after September 4, 2012 at the per diem rate of $32.30, costs and additional reasonable attorneys' fees as allowed by law for costs of collection until the Indebtedness is paid irk full.
