STIPULATIONS AGAINST LIENS

WHEREAS, contemporaneously herewith and prior to commencing construction,
Clarence E. and Susan B. Asbury, husband and wife of 914 Sheffield Avenue, Mechanicsburg, PA
17055 (hereinafter together as "Owner") are preparing to execute a final construction contract with
Lobar Associates, Inc. of 4 Barlo Cimle, Dillsburg, Pennsylvania 17019 (''hereinafter "contractor")
for the construction of a new single story industrial building to be leased by the Asburys to and
occupied by United Rentals, upon a 4.48 acre tract of vacant land in Upper Allen Township, just
west of the boundary line between Upper and Lower Allen Townships, along and between Old
Gettysburg Road and Route 15 in Upper Allen Township, which vacant land was acquired in
separate transactions and has the following multiple deed references:
NOW, October / ~, 2004, at the time of and immediately before the execution of the
final contract, and before any authority has been given by Owner to Contractor to commence work
on the said building, and for the further consideration of One Dollar, to Contractor and
paid by Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any
sub-contractor, nor by any of the materialmen or workmen or any other person for any labor, or
materials purchased, or extra labor or materials purchased for the erection of said building, the
right to file such liens being expressly waived by Contractor.
IN WITNESS WHEREOF, the parties hereto have caused this Stipulation Against Liens
to be executed in their name of the date first above written.
