STIPULATION AGAINST LIENS
THIS AGREEMENT made the ~ day of , 20!

HOMES, INC,, hereinafter referred to as Contractor,
AND
Kevin L. Rogers and Kathy A. Rogers, husband and wife, hereinafter referred to as Owner,
whereby the former undMertro~tok and agreed to erect and.! construct a dwelling on that certain lot of

ground situate in -~o~~?ritSr, Pennsylvania, more particularly bounded and
described in Exhibit "A" attached hereto and made a part hereof.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for
S 8~ A HOMES, INC., in hand paid by Owner, the receipt whereof is hereby acknowledged, and the
further consideration mentioned in the agreement aforesaid, for themselves and their
subcontractors, and all parties acting through or under them, covenant and agree that no
mechanics' liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or rnaterials
furnished by them or any of them under said contract or otherwise, for ,towards, in, or about the
erection and construction of the said buildings on the lot above described and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and reslinquish
the right to have, file, and maintain any mechanics' liens or claims against the said buildincs or any
of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.

Exhibit A
All those two certain tracts of land situate in South Middleton Township, County of Cumberland,
Commonwealth of Pennsylvania, more particularly bounded and described as'. follows:
ON the North by Lot No. 33, Block "E", on the hereinafter mentioned Plan of lots; on the East by I,ot No. 4l
on said Plan of Lots, now or formerly the property of Gary L. Blacksmith; on the South by Lot No. 36, Block
"E" on said Plan of Lots; and on the West by Fairfield Street. Said two lots of ground having a frontage of 100
feet on Fairfield Street, and a depth of 300 feet. Being composed of Lots Nos. 24 and 35, Block "E", of the
certain Plan of Lots laid out by Carlisle Farm Syndicate, and known as "Fairfield," said Plan being recorded in
the Office of the Recorder of Deeds for Cumberland County in Plan Book No. 2, Page 80.
SUBJECT, HOWEVER, to Deed restrictions contained in Deed Book "N" Volume 31, Page 483.
