COMPLAINT
The Plaintiff, The Carter-Jones Lumber Company, by its attorneys, KODAK LAW
OFFICES, P.C., beings this action of Assumpsit against the Defendant(s) to recover the
sum of ONE HUNDRED THREE THOUSAND TWO HUNDRED SIXTY NINE DOLLARS
AND NINETY EIGHT CENTS ($103,269.98), along with interest thereon at the annual rate
of 6% from October 13, 2011 upon a cause of action of which the following is a statement:
1. The Plaintiff, The Carter-Jones Lumber Company, is a corporation organized and
existing under the laws of the State of Ohio, having its principal office and place of
business atI601 Tallmadge Road, Kent, Ohio 44240.
2. The Defendant, HUGHES CONTRACTING, INC., is a corporation having its
principal oi~ice and place of business at 1787 W TRINDLE ROAD #801,
CARLISLE,:. CUMBERLAND COUNTY, PENNSYLVANIA 17015.

3. The Defendant, SETH B. HUGHES, personal guarantor, is an adult individual with
and address of 1787 W TRINDLE ROAD #'801, CARLISLE, CUMBERLAND
COUNTY, I~ENNSYLVANIA 17015.
4. Defendant, NiUGHES CONTRACTING, INC., is a corporation organized and existing
under the laws of the Commonwealth of Pennsylvania, as more fully set forth on the
Pennsylvania Department of State Corporation Bureau print out attached hereto,
marked Exli'ibit "A" and made a part hereof.
5. On or about June 16, 2010, Defendant(s) submitted a Credit Application and
Personal Guaranty to Plaintiff, which credit was granted to Defendant(s), a true and
correct copy of which is attached hereto, marked Exhibit "B" and made a part
hereof.
6. On the dates, in the amounts, and for the prices set forth in a true and correct copy
of the Plaintiff
s Statement hereto attached, marked Exhibit "C" and made a part
hereof, Plaintiff, at the special instance request of the Defendant(s), sold and
delivered goods, wares and merchandise of the kind and description set forth on
said Exhibit and/or performed labor and provided services of the kind and
description het forth on said Exhibit to the total amount of Ninety Nine Thousand
Fifty Eight dollars and Thirty Two Cents ($99,058.32).
7. The prices dharged for said goods, wares and merchandise and/or labor performed
or services provided, were just and reasonable, were the legal and market prices
therefor and were the prices which the Defendant(s) promised and agreed to pay
to Plaintiff.
8. The Defendant(s) paid to Plaintiff on account of the aforementioned charges certain
sums of money in the total amount of Thirteen Thousand Dollars and Zero Cents
($13,000.00 as shown on Exhibit "C".
9. The balance due and owing by Defendant(s) to Plaintiff is the sum of Eighty Six
Thousand Fifty Eight Dollars and Thirty Two Cents ($86,058.32), as appears by
Plaintiff's Statement of Account hereto attached, marked as Exhibit "C" and made a
part hereof.
10. Due to the dlefault of Defendant(s), and pursuant to the terms and conditions of the
Credit Application and/or Personal Guaranty executed by Defendant(s) hereto attached
as Exhibit "B", attorney's fees in the total amount of Seventeen Thousand Two
Hundred Eleven Dollars and Sixty Six Cents ($17,211.66) have been added to said
account.
11. Plaintiff fregjuently demanded payment from Defendant(s) of said amount due and
owing as aforesaid, but Defendant(s) refused and neglected and still refuse(s) and
neglect(s) tq pay said amount or any part thereof.

WHEREFORE, Plaintiff brings this suit to recover from Defendant(s) the sum of ONE
HUNDRED THREH THOUSAND TWO HUNDRED SIXTY NINE DOLLARS AND NINETY
EIGHT CENTS ($1 p3,269.98), together with interest as set forth herein.
