Plaintiff No. vs. ; TIMOTHY WATsON and YVONNE RISSEI~ CIVIL ACTION Defendants : COMPLAINT IN REPLEVIN The above Plaintiff brings this action against the above Defendants to recover certain property as set forth below: 1. Plaintiff, HARLEY DAVIDSON CREDIT CORP., receives mail at, PO Box 21848 Carson City, NV 89721 . 2. Defendant, TIMOTHY WATSON, is located at 245 Old York Road, New Cumberland PA 17070. 3. Defendant, YVONNE KISSER, is located at 28 18`h Street, New Cumberland PA 17011. 4. Defendants entered into a written promissory note and security agreement with Plaintiff or a subsidiary of Plaintiff (collectively "Plaintiff') for the purchase of a Haley-Davison motorcycle ("Contrast"), a true and correct copy of which is attached hereto, made a part hereof and marked Exhibit "A." A true and correct copy of the certificate of title for the motorcycle is attached hereto, made part hereof and marked Exhibit "B." 5. Pursuant to the Contract, Defendants agreed to make regular monthly payments to Plaintiff, as set forth more in detail in the Contract. 6. However, Defendants have failed to make regular monthly payments to Plaintiff in accordance with the' Contract. 7. A total amount which became due as a result thereof, after allowance for all proper credits for payment$ and/or adjustments, if any, was $16,297.71, as set forth in the statement of Defendants' account attached hereto, made part hereof and marked Exhibit "C." 8. Defendants' failure to make regulaz monthly payments to Plaintiff in accordance with the Contract constitutes a breach thereof. 9. Plainttiff has made demand against Defendants for the aforesaid sum, but Defendants failed or refused to pay the same or any part thereof. 10. Pursuant to the Contract, in the event of Defendants' breach thereof, Plaintiff is entitled to immediatee possession of the subject motorcycle. 11. However, Defendants have wrongfully refused to surrender possession of the subject motorcycle to Plaintiff s detriment. 12. As Defendants have breached the Contract and refuses to surrender possession of the subject motorcycle, plaintiff is entitled to immediate possession of the subj ect motorcycle, the value of which is $12,610.100. 13. Upon information and belief, the motorcycle is located at 245 Old York Road, New Cumberland PA 17070. 14. Under the Contract, Plaintiff is entitled to its reasonable attorneys fees, which currently totals $550!,00. WHEREFQRE, Plaintiff demands judgment in the amount of $16,297.71, possession of the subject motorcycle, or in the alternative damages in the amount of $12,610.00, attorneys fees in the amount of $550.00, costs of suit and all other relief to which Plaintiff may be entitled.
