Court Administrator of Pennsylvania DATE: October 4, 2011 RE: JCS/ATJ/CJEA Filing Fee -Extension of the Temporary Surchazge Act 30 of 2011 ("Act 30") amended 42 Pa.C.S. § 3i'33.1 to provide that the "Judicial Computer System /Access to Justice /Criminal Justice Enhancement Account" ("JCS/ATJ/CJEA") fee shall remain $23.50 until December 31, 2014. Specifically, the $11.25 temporary surcharge created by Act 49 of 2009 which was set to expire on January 7, 2012 has been extended to December 31, 2014. For those cases that are instituted upon the filing of a traffic citation under Title 75 (relating to vehicles) which is classified as a summazy offense under a state statute or local ordinance, however, the JCS/ATJ/CJEA fee remains $10.00. The Act 49 surcharge does not apply to summary traffic violations. In accordance with Act 49, the Supreme Court promulgated amendments to the financial regulations governing the collection of the fee and the surchazge, which aze codified at 204 Pa. Code § 29.351. The amendatory language pursuant to Act 30 can be found at 204 Pa. Code § 29.351 (g) (i). Enclosed is a copy of the Supreme Court's Order approving the promulgation of the amendment to the financial regulations dated August 26, 2011. The amended regulation was published in The Pennsylvania Bulletin on September 10, 2011. IN THE SUPREME COURT OF PENNSYLVANIA IN RE: NO. 369 PROMULGATION OF JUDICIAL ADMINISTRATION FINANCIAL REGULATIONS PURSUANT TO ACT 30 OF 2011 DOCKET ORDER PER CURIAM AND NOW, this 26th day of August, 2011, it is ORDERED pursuant to Article V, Section 10(c) of the Constitution of Pennsylvania and Section 3502(a) of the Judicial Code, 42 Pa.C.S. § 3502(a), that the Court Administrator of Pennsylvania is authorized to promulgate the attached Financial Regulations. To the extent that notice of proposed rulemaking maybe required by Pa.R.J.A. No. 103, the immediate promulgation of the regulations is hereby found to be in the interest of efficient administration.
