R.CP. §2951 for judgment by confession and avers the following: Plaintiff, Fulton Bank, N.A., formerly known as Fulton Bank, ("Fulon"), is a national banking association with a principal location of One Penn Square, P. O. Bo7c 4887, Lancaster, Pennsylvania 17604. 2. Defendant, Herre Bros., Inc., is a Pennsylvania business corporation, with a registered address of4417 Valley Road, Enola, Pennsylvania 17025. 3. On bx about February 1, 2000, Defendant, in connection with a comanercial loan, executed and deliverred to Fulton a Line of Credit Note and Agreement ("Note") in the original 3686242.1 principal sum of $3,000,000.00. A true and correct copy of the Note is attached hereto as Exhibit "A" and incorporated herein by reference. 4. The Note carries interest at a rate described in the Interest Rate Addendum as attached in the Note and requires Defendant to make monthly payments of interest only. 5. Defendant defaulted under the Note by failing to make payment upon demand. 6. Pursuant to the Note, if Defendant fails to make payments required'under the Note, Fulton may, end hereby does, declare the entire balance of principal and interest under the Note to be due and payable immediately. 7. 'I`he Note authorizes confession of judgment against Defendant for all amounts due under the Note plus continuing interest, continuing late charges and attorneys' flees, plus the cost of any legal proceedings. 8. Pursuant to the Note, in the event of Default, Fulton is entitled to b~ reimbursed for all costs and explenses, including an attorneys commission of fifteen (15%) percent of the unpaid principal balance plus accrued interest for collection, plus the cost of any leg~1 proceedings. 9. Fulton has demanded payment of the amount owed from Defendant, but Defendant has failed and/or has refused to pay the same. 11. The Note has not been assigned and Fulton is the owner and holder thereof. 12. No Prior Judgment has been entered on the Note in any jurisdiction. 13. Judgment is not being entered by Confession against a natural person in connection with a consumer credit transaction. WHEREFORE, Plaintiff, Fulton Bank, formerly known as Fulton Bank demands judgment against Defendant, Herre Bros., Inc., in the total amount of $3,037,344.03, consisting of a principal amount of $2,618,882.92, interest through February 13, 2012 in the amount of $21,877.58, late chairges in the amount of $469.46, and attorneys' fees in the amount of $396,114.07, plus continuing interest after February 13, 2012 at a rate of $290.98 per diem, plus continuing late chazges and costs.
