RE: In Re: Kathleen M. Knisely, an Alleged Incapacitate Person
Orphans' Coux'~,No. 21-20120946
Dear Judge Guido:
,:
I write to you regarding your order of August 31, 2012, entered immediately
following the conclusion of the hearing for appointment of a temporary guardian in
the matter above. If you recall, Mrs. Knisely testified at the hearing via telephone
from our offices.
Mrs. Knisely, mainly by her son, Dr. Samuel Scott Knisely, consulted our
firm on Thursday, August 30, 2012, regarding possible representation of his mother.
We agreed to meet with Mrs. Knisely and Dr. Knisely at 10:00 A.M. on Friday,
August 31, 2012. When I arrived earlier that morning, I was greeted by Mrs.
Knisely and Dr. Knisely, who informed me that a temporary guardianship hearing
had been scheduled at 9:30 A.M.
Upon learning of the impending hearing, I advised Mrs. Knisely that she
should report to the Court for the hearing. Inasmuch as a trip to Carlisle could not
be made in time at that point, I offered our facilities for her to telephone the
courtroom. As a courtesy to Mrs. Knisely, my colleague Todd F. Truntz, Esquire
and I sat in on the hearing to offer limited procedural assistance.
Prior to Mrs. Knisely's testimony, I indicated to the Court that neither I nor
the law firm of Saidis, Sullivan & Rogers was entering an appearance. Given the
emergent nature of the matter, we were not in a position to offer our representation

at that time. Following the hearing, we offered our services to Mrs. Knisely, but she
has not retained us as counsel.
When I read the Order dated August 31, 2012, I noted that my name and
address are listed in the distribution legend. By this letter, I wish to inform the
Court that, as of this date, neither I nor the law firm of Saidis, Sullivan & Rogers
have been retained by Mrs. Knisely, and we will not be entering our appearance in
this matter. Accordingly, no member of this firm will appear at the guardianship
hearing on October 26, 2012, on Mrs. Knisely's behalf.
I am of the understanding that since no official appearance was entered, we
are not required to petition the Court for leave to withdraw. I would appreciate the
Court's notice if my understanding is not correct.
Please feel free to contact me at any time if the Court has any questions or
concerns. Thank you very much for your consideration.
Sincerely,
~ ~~~
