LAST WILL AND TESTAMENT
OF
TWYLA W. KANN
I, TWYLA W. KANN, of 9 Graham Road, Nev, wille, West Pennsboro Township,
Cumberland County, Pennsylvania, being of sound mind, memory and disposition, do hereby
make, publish and declare this my Last Will and Testament, hereby revoking and making void
any and all Wills, Codicils, or writings in the nature thereof, by me at any time heretofore made.
FIRST: PAYMENT OF EXPENSES - I direct that all my just debts and funeral expenses,
including my gravemarker and all expenses of my last illness, shall be paid from my residuary
estate as soon as practicable after my decease as a part of the administration of my estate.
SECOND; RESIDUE OF ESTATE - I give, devise and bequeath all the rest, residue and
remainder of my estate, be it real, personal, or mixed, of whatsoever kind and wheresoever
situate equally to my children, RAND L. KANN, RICHARD W. KANN, II and TWYLA O.
STOUFFER. However, if a child does not survive me and leaves children who so survive me,
such children shall receive, per stirpes (by representation), the share my child would have
received had he or she so survived me.
THIRD: CLAIM OWED TO MY ESTATE - I further advise my executor or executrix
hereinafter named that my son, RICHARD W. KANN, II, is personally indebted to me for the
sum of FORTY-ONE THOUSAND ($ 41,000.00) DOLLARS at the time of execution of this
' my Last Will and Testament. My son has been instructed to retain any and all receipts which I
shall provide to him for any payments made to me toward these debts. I further have kept an
accounting of any and all payments made to me by my said son on these accounts. I direct my

executor or executrix hereinafter named to deduct the total balance due as determined from the
total gross sum that 1 have set forth above minus any documented receipts, from any benefit that
my son, RICHARD W. KANN, II, would otherwise have received hereinunder. In the event that
the total due to him under Paragraph SECOND(B) is less than the total due by him to the estate,
he shall pay into the estate in order that the other txvo children shall receive the amount for which
they are entitled.
FOURTH: EXECUTOR - I appoint my son, RAND L. KANN, Executor of my Will. In the
event that he predeceases me or is umvilling or unable to serve as Executor, I then appoint my
daughter, TWYLA O. STOUFFER, Executrix of my Will. If she is unwilling or unable to serve
as Executrix, I then appoint my son, RICHARD W. KANN, II, Executor of my Will. Neither my
Executor nor any successor shall be required to give bond for the performance of their duties.
I grant to my Executor and successors the power to compromise claims without court
approval and without the consent of any beneficiary.
FIFTH: PROTECTIVE PROVISION - To the greatest extent permitted by law, before actual
payment to a beneficiary or to his or her account, no interest in income or principal shall be
assignable by a beneficiary or available to anyone having a claim against a beneficiary.
