DECLARATORY JUDGMENT ACTION
PETITION TO AMEND ORDER DATED SEPTEMBER 26, 2012
AND NOW, comes James Neff, Administrator of the Estate of Leroy D. Smith,
Jr., Deceased, by and through his attorney, Michael A. Scherer, Esquire, and
respectfully reprF~sents as follows:
1. Judge Placey has been assigned to this case.
2. Judge Placey signed an Order of Court dated September 26, 2012 in this
matter, which Order is attached hereto as "Exhibit A. "
3. In requesting the assistance of the Cumberland County Sheriff's office to
assist the estate in obtaining possession to the real estate located at 344 Old State
Road, Gardners, Cumberland County, Pennsylvania 17324, undersigned counsel
learned that the Sheriff would require certain language to be included in the Court
Order, which language has been included in the suggested Order which is attached
hereto.
WHEREFORE, undersigned counsel respectfully requests that this Honorable
Court enter an Order in the form attached.
