for the erection or construction of a SINGLE FAMILY DWELLING upon the lot of ground
known as 12 Windswept Way, Camp Hill, PA 17011East Pennsboro Township, Cumberland
County, Pennsylvania, described in Exhibit "A" hereof, of which Douglas V. Badali and Cheryl
A. Badali are the title holders of record, as more particulazly described in -Deed

Now, September 26, 2012, at the time of and immediately before the execution of the
principal contract, and before any authority has been given by the Owners to the Contractor to
commence work on said building or improvement, to purchase materials for the same, it is

hereby stipulated and agreed by and between said parties as part of said contract and for the 11

consideration therein set forth, neither the undersigned Contractor, any Sub-contractor or
materialman, nor any other person furnishing labor or materials to the said Contractor under the
contract entered into between said parties, shall file a lien for work done or material furnished to
said building, improvements or any part thereof.
This stipulation is made and intended to be filed with the Prothonotary within 10 days
after date in accordance with the requirements of the Act of August 24, 1963, P.L. 497, as
amended,

ALL THAT CERTAIN piece or parcel of land situate in East Pennsboro Township, Cumberland
County, Pennsylvania, more particularly bounded and described as follows, to wit:
BEGINNING at a point located. on the southern right-of-way line of Windswept Way at the
dividing line between Lots F24 and F23 on the hereinafter referenced Plan; thence along the
eastern boundary line of Lot F24, South 21 degrees 58 minutes 00 seconds East, a distance of
175.32 feet to a point on the northern boundary line of Lot F17 of Floribunda Heights, Phase 1,
Section 10.A; thence along the northern boundary line of Lot F17, North 62 degrees 45 minutes
00 seconds East, a distance of 107.65 feet to a point at the southwest corner of Lot F22 of the
Pealer Land Development Subdivision Plan; thence along the western boundary line of Lot F22,
North 20 degrees 15 minutes 00 seconds West, a distance of 162.64 feet to a point on the
southern right-of-way line of Windswept Way; thence along Windswept Way, South 69 degrees
45 minutes 00 seconds West, a distance of 87.32 feet to a point; thence continuing along the
same, by a curve to the left, having a radius of 500.00 feet and an arc length of 14.98 feet to a
point; thence continuing along the same, South 68 degrees 02 minutes 00 seconds West, a
distance of 9.80 feet to a point, the point and place of BEGINNING.
BEING Lot F23 on the Final Subdivision Plan of Floribunda Heights, Phase I, Section 10.B and
recorded in the Cumberland County Recorder of Deeds Office at Instrument No. 201200886.
CONTAINING 18,535 square feet or 0.43 acres.
UNDER AND SUBJECT, NEVERTHELESS, to all easements, restrictions; encumbrances and
other matters of record or that which a physical inspection or survey of the premises would
reveal.
