HomeMy WebLinkAbout9-21-12FAMILY SETTLEMENT AND FINAL RELEASE IN THE ESTATE OF ESTHER E. PROWELL KNOW ALL MEN BY THESE PRESENTS, that WHEREAS, ESTHER E. PROWELL, late of 277 Hillcrest Road, Camp Hill, Cumberland County, Pennsylvania, deceased, died testate on September 10, 2011; WHEREAS, letters testamentary for the estate of the said decedent were duly issued on October 6, 2011, by the Register of Wills of Cumberland County, Pennsylvania, to JOYCE E. SWEIGARD, Executrix, and YVONNE W. GETTYS, Executrix, hereinafter together called personal representatives, for the Estate of ESTHER E. PROWELL, Number 2011-01053; WHEREAS, said personal representatives have gathered the assets of the Estate of said decedent in regard to real property known as 113 Fairview Drive, Camp Hill, Cumberland County, Pennsylvania; WHEREAS, said personal representatives have gathered the assets of the Estate of said decedent in regard to personal property; WHEREAS, the heirs of said decedent are indicated in the Will as: Carol J. Hoffman, Joyce E. Sweigard, Joseph E. Hoffman, Yvonne Gettys, and Shirley A. Sucic; and are each entitled to a 20% share of the Estate as set forth in the Will and in Schedule J of the Inheritance Tax Return filed on May 16, 2012, and made a part hereto by reference; NOW THEREFORE, KNOW YE, that we, Carol J. Hoffman, Joyce E. Sweigard, Joseph E. Hoffman, Yvonne Gettys, and Shirley A. Sucic, the named heirs of the Estate of ESTHER E. 2012 SEP 21 (:1J?RK t)La (>1Z1'I L1N~ (:OUR'1' t:~'~~Ilil?LZI..A~ll (:OUll'I', P:1 ~~ PROWELL, and being those persons entitled to inherit under the Will of ESTHER E. PROWELL, do hereby, each of us, acknowledge that we authorize the personal representatives to disburse the remaining portions of the assets of this Estate. AND, each of us do hereby stipulate that in order to avoid the expense and time involved in the filing of a formal account and schedule of distribution, we each agree that no account is necessary and we do hereby agree that we consent to distribution being made by a family settlement agreement without the filing of an account and schedule of distribution, the same to be with the same force and effect as if they had been filed and confirmed by the Orphans Court Division of the Court of Common Pleas, Cumberland County Branch. THEREFORE, we and each of us do hereby remise, release, quitclaim and forever discharge the said personal representatives, their heirs, executors, and administrators and assigns, of and from the said estate and from all actions, suits, payments, accounts, reckonings, claims and demands whatsoever for or by reason thereof, or for any other use, matter, cause or thing whatsoever touching upon the real estate sale described herein and each of us do further hereby covenant and agree that should any liability come due to the estate of the said decedent after the signing of this agreement, we and each of us do hereby covenant and agree with each other and the aforesaid personal representative that we will contribute pro rata our share of the estate to satisfy any and all claims, demands, suits, or causes of action which may be successfully prosecuted against the said estate or the aforesaid personal representative after the signing, sealing and delivery of this family settlement agreement and final release. 2 IN WITNESS WHEREOF, we have hereunto set our hands and seals on the date shown at our respective notary endorsements.
