WAUGHEN, Owner : IN THE COURT OF COMMON PLEAS : CUMBERLAND COUNTY, PENNSYLVANIA THE MCNAUGHTON COMPANY, INC., Contractor WHEREAS, JAMES E. WAUGHEN and TRACEY J. WAUGHEN of 103 South Lingle Avenue, Palmyra, Pennsylvania, is about to execute contemporaneously herewith, a contract, with THE MCNAUGHTON COMPANY, INC. of 4400 Deer Path Road, Harrisburg, Pennsylvania, for the erection of a building upon premises commonly known as 2188 CANTERBURY DRIVE, Towns.hi~ UPPER ALLEN, CUMBERLAND County, Pennsylvania, as set forth in the deed datedCX-~c~q~' recorded at Deed Book , Page __, in the Recorder's Office for CUMBERLAND County, Pennsylvania, as more specifically described in Exhibit "A" which is incorporated herein and attached hereto. NOW, October 18;, 2004, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. W~AUG~HEN~~ Exhibit "A" ALL that certain piece, parcel or lot of land situate in UpI~er Allen Township, Cumberland County, Pennsylvania, and bounded and described as follows: BEGINNING at a point on the Northern right-of-way line of Canterbury Drive (50.00 feet wide), said point being located at the Southeastern corner of Lot No. 172; then along the Eastern boundary of Lot No. 172 and along the center line ora 25.00 foot wide drainage easement, through a 10.00 foot wide UGI right-of-way, two (2) 50.00 foot wide building restriction areas, and a 100.00 foot wide utility e~ement, North 20 degrees 13 minutes 54 seconds East, for a distance of 242.34 feet, to a point in line of lands now or formerly of St. Luke's Episcopal Church; then along said lands of St. Luke's Episcopal Church, and passing through a 50.00 foot wide building restriction area, South 65 degrees 27 minutes 20 seconds East, for a distance of 104.30 feet to a point at the Northwestern corner ofLo, t No. 170, then along the Western boundary of Lot No. 170, and through two (2) 50.00 foot wide building restriction areas, a 100.00 foot wide utility easement, and a 10.00 foot wide UGI fight-of-way, South 20 degrees 13 minutes 54 seconds West, for a distance of 234.49 feet, to a point on the Northern right-of-way line of Canterbury Drive; then along said fight-of-way line of Canterbury Drive, North 69 degrees 46 minutes 06 seconds West, for a distance of 104.00 feet, to a point ,nd the place of BEGINNING. This piece, parcel or 10t of land is known and numbered as Lot No. 171 on thc Final Subdivision Plan for Canterbury Estates, Phases IX and X, which is recorded in Cumberland County in Plan Book 83, Page 91.
