Defendant, Luke Deatrick individually and d/b/a Runt's Paving & Excavating, is an adult individual with a last known address of 90 Smith Rd, Newville, PA 17241. 3. Runt's Paving & Excavating is a Pennsylvania Registered Fictitious Name owned by Defendant, Luke Deatrick. 4. Defendant entered into a Billing Agreement, hereinafter referred to as "Agreement", as more specifically shown by Plaintiff s Agreement. A true and correct copy of the Agreement, and the terms and conditions of which were agreed upon by the parties, are attached hereto, marked as Exhibits " 1 " and " 2" and made a part hereof. 5. Pursuant to Plaintiff s Account Summary dated May 14, 2012, and at the specific instance and request of Defendant, Plaintiff provided professional advertising services to Defendant, as more specifically shown. by Plaintiff s Account Summary. A true and correct copy of Plaintiffs Account Summary is attached hereto, marked Exhibit " 3" and made a part hereof. 6. Defendant received and accepted the aforementioned professional advertising services which were provided by Plaintiff. 7. The prices charged by Plaintiff were fair and reasonable and were the market prices that prevailed at the time of the transactions at issue. The prices charged by Plaintiff. were the prices that Defendant agreed to pay. 9. Plaintiff avers that there is a balance due and owing from Defendant in the amount of $10,990.55, as is shown by Plaintiff's Account Summary attached hereto as aforementioned Exhibit "3" and made a part hereof. 10. Plaintiff avers that the Agreement between the parties provides that Defendant will pay Plaintiff s reasonable attorneys' fees. 11. Plaintiff avers that such attorneys' fees amount to $1,500.00. 12. Although repeatedly requested to do so by Plaintiff, Defendant has willfully failed and/or refused to pay the aforementioned balance, attorneys' fees or any part thereof to Plaintiff. WHEREFORE, Plaintiff demands Judgment in its favor and against Defendant Luke Deatrick individually and d/b/a Runt's Paving & Excavating, in the amount of $10,990.55 with interest at the statutory rate of 6.00% per annum from the date of judgment, plus attorneys' fees of $1,500.00 and costs.
