RUSSELL, DECEASED DISCLAIMER OF LINDA H. RUSSELL WHEREAS, RICHARD L. RUSSELL (the "Decedent") died on January 19, 2012, a resident of Cumberland County, Pennsylvania, leaving a Will dated August 3, 1999 which was probated on September Z~ , 2012, and Letters Testamentary were granted to LINDA H. RUSSELL, who has qualified as Executrix and is still acting as such; and WHEREAS, the Decedent maintained an Individual Retirement Account number 636272 at Morgan Stanley Smith Barney, LLC (the "Morgan Stanley IRA"), providing for the disposition of said account to LINDA H. RUSSELL, as primary beneficiary, and to the Trustee of the Trust under Paragraph D of Article Eighth of the Richard L. Russell Trust dated May 10, 1995 as contingent beneficiary in the event of disclaimer by LINDA H. RUSSELL; and WHEREAS, the undersigned, LINDA H. RUSSELL, desires to irrevocably disclaim, renounce, relinquish and release all her rights as primary beneficiary of the Morgan Stanley IRA; and WHEREAS, the above action by LINDA H. RUSSELL will result in the amount so disclaimed passing to the Trustee of the Trust under Paragraph D of Article Eighth of the Richard L. Russell Trust dated May 10, 1995; and WHEREAS, the undersigned has not heretofore received nor accepted any distribution of income or principal from said Morgan Stanley IRA; and WHEREAS, less than nine (9) months have elapsed since the Decedent's death. NOW THEREFORE, I, LINDA H. RUSSELL, DO HEREBY IRREVOCABLY DISCLAIM, RENOUNCE, RELINQUISH AND RELEASE all my rights as primary beneficiary of the Morgan Stanley IRA, causing said property to pass to the Trustee of the Trust under Paragraph D of Article Eighth of the Richard L.
