COMPLAINT TO OBTAIN JUDGMENT ON MECHANICS' LIEN CLAIM
The Plaintiffs are John H. Myers & Son - US LBM, LLC, and Myers Holdings,
Inc., formerly John H. Myers & Son, Inc., which have a principal place of business at 2200
Monroe Street, York, PA 17405 (Plaintiff).
2. Defendant is William D. Keeley, Inc., 512 Partridge Court, Mechanicsburg, PA
17050 (Defendant).
3. Plaintiff sells a wide range of building materials and supplies to the public and to
those engaged in the construction trade.
4. Plaintiff, as a Subcontractor, sold and supplied building materials to Defendant, as
a Contractor, which were incorporated into and made a part of the erection and construction of a
four unit townhouse/condominium known as 9, 10, 11, and 12 Westover Drive, Mechanicsburg,
in the Village of Westover (East Section) Phases V and VI, Hampden Township, Cumberland
County, Pennsylvania 17055 (Property).
5. The last day Defendant supplied material to the Property was September 7, 2011.
6. Despite Defendant's acceptance of delivery of the material and despite Plaintiffs
repeated demands for payment, Defendant failed to pay for the material supplied.
7. On March 1, 2012, Plaintiff filed a Mechanics' Lien Claim against Defendant, the
owner of the Property, in the total amount of $28,061.60, apportioned among the four townhouse
condominium units, as follows:
9 Westover Drive - Parcel 10-10-1604-152.U9 - $7,015.40
10 Westover Drive - Parcel 10-19-1604-152.U10 - $7,015.40
11 Westover Drive - Parcel 10-19-1604-152.UI I - $7,015.40
12 Westover Drive - Parcel 10-19-1604-152.UI I - $7,015.40
A copy of the Mechanics' Lien Claim, filed to No. 12-1367, is attached and made
a part hereof as Exhibit A. Notice of the Filing of the Claim was timely served upon Defendant
on March 2, 2012, as evidenced by the Sheriff s Return of Service, attached and made a part
hereof as Exhibit B.
9. On or about July 12, 2012, Plaintiff received a partial payment on account of the
sums due and owing, and it therefore filed a Partial Release as to the townhouse condominium
unit situate at 9 Westover Drive - Parcel 10-10-1604-152.U9. A copy of the Partial Release is
attached and made a part hereof as Exhibit C.
10. The sum of $21,242.96 remains due to Plaintiff on account of the material
supplied, and the Mechanics' Lien Claim has not been satisfied.

11. Defendant was the record owner of the Property at the time the Mechanics' Lien
Claim was filed and is the present owner of Property identified as 10 Westover Drive - Parcel
10-19-1604-152.U10, 11 Westover Drive - Parcel 10-19-1604-152.U11, and 12 Westover Drive
- Parcel 10-19-1604-152.U11.
WHEREFORE, Plaintiffs, John H. Myers & Son - US LBM, LLC and Myers Holdings,
LLC, demand judgment against Defendant, William D. Kelley, Inc., in the amount of
$21,242.96, plus post judgment interest as allowed by law.

undersigned counsel, file the following Mechanics' Lien Claim:
1. The Claimants are John H. Myers & Son - US LBM, LLC, and Myers Holdings,
Inc., formerly John H. Myers & Son, Inc., which have a principal place of business at 2200
Monroe Street, York, PA 17405. Claimants file this Claim as a Subcontractor.
2. The Owner of the real estate against which this claim is filed is William D.
Keeley, Inc., 512 Partridge Court, Mechanicsburg, PA 17050.
3. The last day Claimant supplied material was September 7, 2011.
4. The party with whom Claimant contracted was William D. Keeley, Inc..
5. Formal notice of Claimant's intention to file this Mechanics' Lien Claim was
given to the Owner by certified mail on January 26, 2012. A true and correct copy of the Notice

of Intent to File Mechanics' Lien Claim with the return of service are attached and made a part
hereof as Exhibit A.
6. The material supplied by Claimant was pursuant to the purchase orders of
William D. Keeley, Inc.
7. The general nature of the material supplied by Claimant is described on the
invoices attached and made a part hereof as Exhibit B and was incorporated into and made a part
of the erection and construction of a four unit townhouse/condominium known as 9, 10, 11, and
12 Westover Drive, Mechanicsburg, PA 17055.
8. The prices charged for the material are as stated on the invoices attached as
Exhibit B. The total amount claimed to be due is $28,061.60, which amount is apportioned
among the four townhouse condominium units in the amount of $7,015.40 each, as follows:

9. The real property subject to the lien is situate in Hampden Township, Cumberland
County, Pennsylvania, known as 9, 10, 11 and 12 Westover Drive, Mechanicsburg,
Pennsylvania, as shown on a plan of lots entitled The Village of Westover (East Section) Phases
V and VI, as recorded in Cumberland County, Pennsylvania Plan Book 60, page 74. A copy of
said Plan is attached and made a part hereof as Exhibit C.

WHEREFORE, Claimants, John H. Myers & Son - US LBM, LLC and Myers Holdings,
LLC, claim to have a lien upon 9, 10, 11 and 12 Westover Drive, Mechanicsburg, PA 17055 in
the total sum of $28,061.60, and in the amount of $7,015.40 allocated to each unit.
