On July 8„ 2011 a guardianship hearing was held before Judge Guido. Cumberland
County Aging and Community Services was appointed his Permanent Plenary Guardian
of Person and Estate. Mr. Benami had lived at the Molly Pitcher Hotel and moved to
public housing when it closed. At the time of the hearing, Mr. Benami was a patient at
Holy Spirit Behavioral Health. Upon discharge, he was placed at Manor Care-Carlisle
where he still resides.
He was diagnosed with: dementia, hypertension, anemia, congestive heart failure,
generalized weakness, unsteady gait, legally blind, glaucoma, chronic paranoid
schizophrenia, anxiety, history of rambling speech and history of disorganized speech.
He is at risk for falls due to his unsteady gait and vision impairment. He has episodes of
incontinence of bowel and bladder. His medications must be administered to him and he
requires cueing and reminders for activities of daily living, such as personal care. He
requires total assistance with his instrumental activities of daily living such as laundry
and meal preparation.
Mr. Benami seemed to adjust well to life at the nursing home. He eats his meals in the
dining room, likes the food, and has no issues with his roommates or other residents.
He spends a lot of time in his room listening to his radio which is his favorite activity. A
talking watch was purchased for him from the Tri-County Blind Association.
Mr. Benami was visited by Aging staff every 30-60 days and staff attended quarterly
care plans where they met with nursing, dietary, activities, and social services staff.
His brother, Alfred Means who lives in Philadelphi is kept informed of our visits.
It is the request of the Cumberland County Office of Aging that the agency retain
Guardianship of Person and Estate for David Benami. Manor Care-Carlisle has
demonstrated an adequate quality of care for his medical problems. We believe,
therefore, that David Benami should continue to reside in that nursing facility.

After becoming guardian, the agency set up a guardianship checking account for him at
F&M Trust. Application was made to Social Security for the agency to become rep
payee and this was granted. We also verified with them that Mr. Benami's SSI had been
stopped since he was no longer living in the community. Several clothing items
including shoes were purchased for him as all his clothing had been destroyed because
they had been badly soiled.
His only source of income is Social Security. At the time of the hearing it was $454 a
month, but starting this year, it was raised to $471. The monthly payment to Manor Care
is currently $326.00. Cumberland County Aging receives a monthly guardianship fee of
$100 as allowed by Medical Assistance and was included in the court order. The Court
also ordered Mr. Benami to pay for his attorney expenses. Michael Palermo's total bill of
$675.00 was paid in pull with two payments.
A summary of David Benami's income and expenses are attached. Also included is a
copy of the check register.
