WILSON, : N/K/A EVELYN NEWAY, INDIVIDUALLY Defendants :ACTION FOR QUIET' TITLE COMPLAINT 1, Plaintiff is Norman Mundis, d/b/a Mundis Brothers, with a principal place of business located at intersection of Carlisle and Dauphin Street, Enola, Cumberland County, Pennsylvania, and an office located at 679 Potts Hill Road, Lewisben•y, Pennsylvania. 2. Defendant is Evelyn Wilson, n/k/a Evelyn Neway, an adult individual residing at 301 Dauphin Street, F?nola, Pennsylvania 17025. 3. Defendant qualified as the personal representative for t:he Estate of Evelyn G. Mundis, whose date of death is December 17, 2005. 4. Defendant is a beneficiary of the Estate of Evelyn G. Mundis, Deceased. 5. Schedule A of the Pennsylvania Inheritance Tax Return for Decedent Evelyn G. Mundis (hereinafter "Decedent") indicates that Decedent owned the following property: .25 acres undeveloped land East Pennsboro Township, Cumberland County, Pennsylvania., valued at four thousand dollars 1;$4,000.00). A copy of Schedule A, of the Inheritance Tax Return is attached hereto as Exhibit "A" and incorporated herein. 4 6. Plaintiff believes, and therefore avers, that the .25 acres listed on Schedule A of the Inheritance Tax Return refers to a .45 acre parcel of land identified as tax parcel number 09- 14-0834-078, which is commonly referred to as Carlisle Street, Enola, Cumberland County, Pennsylvania ("the Property"). A copy of Tax Mapper for Cumberland County, Pennsylvania for tax parcel number 09-14-0834-078 is attached hereto as Exhibit "B" and incorporated herein. 7. Contrary to the information contained on Decedent's Inheritance Ta.x Return, the Property is not undeveloped and the value of the land acid building exceeds $4,000.00. 8. The Deed for the Property is recorded with the Cumberland County Recorder of Deeds at Book 16M, Page 250, a copy of which is attached hereto as Exhibit "C" and incorporated herein. The description in the Deed thereof encompassed and contained the following piece of land: On the south by Dauphin Street, on Plan referred to below; on tlne west by Carlisle Street, on said Plan; on the north by an alley, on said Plan; and on the east by Lot No. 1, Block "A", on said Plan. Containing one hundred four (104) feet in front on Dauphin Street, and extending back on the east side along Lot No. 1, Block "A", one hundred fifty-eight and three-tenths (158.3) feet, and on the west side along Carlisle Street one hundred eighty-three and six-tenths (183.6) feet to the aforesaid alley, and extending one hundred twenty-six and eight-tenths (126.8) feet along said alley, and being Lots Nos. 2 and 3, Block "A", on Plan of Lots laid out by Arthur R. Rupley and called Enola Terrace, and recorded in Plan. Book 1, Page 3. 9. Plaintiff is currently in possession of the property and parcel located at the intersection of Carlisle and Dauphin Street, Enola, Cumberland County, Pennsylvania. COUNT I -QUIET TITLE ACTION PLAINTIFF v. DEFENDANT EVELYN G. WIISON N/K/A EVELYN NEWAY PERSONAL REPRESENTATIVE OF THE ESTATE OF EVELYN G. MUNDIS 10. Paragraphs 1 through 8 above are hereby incorporated by reference as if fully set forth herein. 5 11. In 1976, Karl J. Mundis sustained a cervical spine injury which prevented him for performing the physical work required to run Mundis Brothers. Because Karl J. Mundis was physically unable to work, Norman Mundis took over Mundis Brothers. Although Norman Mundis took over the physical work associated with Mundis Brothers, Karl J. Mundis continued to do the bookkeeping and the mail. 12. In 1977, Norman Mundis took over the business in its, entirety; however, Karl J. Mundis continued to assist with the bookkeeping. The income tax form filed by Norman Mundis for 1977 reflects that Norman Mundis became the sole proprietor of Mundis Brothers that year. A copy of the 1977 Income Tax Return is attached hereto as Exhibit "D" and incorporated herein. 13. Plaintiff paid Karl J. Mundis $70,000.00 for the business, which. included the Property. 14. Upon becoming the sole owner of Mundis Brothers. P aintiff believed that the Property had been properly deeded either to himself or Mundis Brothers. 15. Unbeknownst to Plaintiff, the Deed for the Property remained in the name of Karl J. Mundis. See Deed recorded with the Cumberland County Recorder of Deeds at Book 16M, Page 250. a copy of which is attached hereto as Exhibit "C" and incorporated herein. 16. Plaintiff did not become aware of the error until Defendants' included the property in the list of ;~ sets of Evelyn G. Mundis' Estate. 17. Evelyn G. Mundis was the widow of Karl J. Mundis. 18. Karl J. Mundis died on March 13, 1992. 19. Karl J. Mundis' Estate was not probated. 6 20. From the time of Karl J. Mundis' death until the filing of the Pennsylvania Inheritance Tax Return, Evelyn G. Mundis never challenged Norman Mundis' interest in the Property. 21. From 1977 to the present, Evelyn G. Mundis did not make any contributions, financial or otherwise, to the maintenance the Property. 22. From 1977 to the present, Evelyn G. Mundis did not pay any taxes assessed on the Property. 23. Plaintiff is currently in possession of the Property as dlescribed in paragraphs 6 and 7 herein. 2~. Plaintiff has continuously been in possession of the property from 1977 to the present. 2`~. From 1977 to the present, Plaintiff has done business on the Property as Mundis Brothers. WHEREFORE, Plaintiff requests the Court enter judgment in favor of Plaintiff granting title interest to the Property as described by Exhibit C to Plaintiff. COUNT II -ADVERSE POSSESSION PLAINTIFF v. DEFENDANT EVELYN G. WIISON N/K/A EVELYN NEWAY PERSONAL REPRESENTATIVE OF THE ESTATE OF EVELYN G. MUNDIS 26. Paragraphs 1 through 25 above are hereby incorporated by reference as rf fully set forth herein. 27. Plaintiff has been using the Property since at least 1977. 28. From 1977 to the present, Plaintiff has continuously occupied and possessed the Property to the exclusion of all others and without permission, authorisation or consent of 7 Defendants or anyone else and has demonstrated his continuing and uninterrupted possessory interest in the Property by the following actions: a. Operation of a business on the Property; b. Continuous maintenance and improvement of the Property; c. Payment of all taxes relating to the Property; d. Payment of all insurance related to the Property; and e. Payment of all utilities and trash services associated with the Property. 29. Additionally, it is believed and therefore averred that Defendant Evelyn Wilson, n/k,~a Evelvn Neway, disposed of additional records establishing Norman Mundis' :interest in the Property that were retained at 301 Dauphin Street, Enola, Pennsylvania 17025, where Karl J. Mundis and Decedent Evelyn G. Mundis resided. WHEREFORE, Plaintiff requests the Court enter judgment in favor of Plaintiff`granting title interest to the Property as described by Exhibit C to Plaintiff. COUNT III -QUIET TITLE ACTION PLAINTIFF v. DEFENDANT EVELYN G. WILSON N/K/A EVELYN NEWAY. INDIVIDUALLY 30. Paragraphs 1 through 29 above are hereby incorporated by reference as if fully set forth herein. 31. In 1976, Karl J. A copy of Norman Mundis' 1977 Income Tax Return is attached hereto as Exhibit "D" and incorporated herein. 3 ~. Plaintiff paid Karl J. Mundis $70,000.00 for the business, which included the Property. 34. DEFENDANT EVELYN G. WILSON N/K/A EVELYN NEWAY. INDIVIDUALLY 46. Paragraphs 1 through 45 above are hereby incorporated by reference as if fully set forth herein. 47. Plaintiff has been using the Property since at least 197"7. 48.
