O~-(¢O9 P1~erm, 2002 PARAMOUNT DEVELOPMENT, INC., Contractor : WHEREAS, Paramount Development, Inc., a Pennsylvania Corporation of Dauphin County, Pennsylvania (herein "Owner") is about to execute contemporaneously herewith, a contract, with Paramount Development, Inc. of Dauphin County, Pennsylvania (herein "Contractor"), for the erection of a building upon Lot No. 17, Hampden Township, Cumberland County, Pennsylvania, more particularly set forth on Exhibit "A" attached hereto and made a part hereof. NOW, February 1,2002, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Owner and the further consideration of One ($1.00) Dollar in hand paid to Contractor by Owner it is agreed that no lien shall be filed against the building by the Contractor, or any sub- contractor, nor by any of the material-men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived· WITNESS, our hand and seals the day and year aforesaid. EXHIBIT A ALL THAT CERTAIN tract of land in Hampden Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows, to wit: BEGINNING at an iron pin to be set, a common point along lands now or formerly of Pinehurst Hills Unit No. 17 and Pinehurst Hills Unit No. 18 and the Western right-of-way of Adeline Drive; THENCE along Unit No. 18 of Pinehurst Hills, South Seventy-five Degrees Fifty-two Minutes One Second West, a distance of Two hundred ten and Fifteen Hundredths feet (210.15') to an iron pin to be set; THENCE along Unit No. 20 of Pinehurst Hills, North Twenty-seven Degrees Forty-six Minutes Forty-nine Seconds West, a distance of One hundred forty-one and Twenty-seven Hundredths feet (141.27') to an iron pin to be set; THENCE along Unit No. 16 of Pinehurst Hills, North Seventy-two Degrees Fifty-nine Minutes Twenty-four Seconds East, a distance of Two hundred twenty-eight and Fifty-eight Hundredths feet (228.58') to an iron pin to be set along the Western right-of-way of Adeline Drive; THENCE continuing along the Western right-of-way of Adeline Drive by a curve to the right having a radius of Two hundred and Zero Hundredths feet (200.00'), a Chord Beadng of South Twenty-four Degrees Fifty- seven Minutes Forty Seconds East (S 240 57' 40"E), an arc length of Fifty-three and Thirty-one Hundredths feet (53.31'), and a chord length of Fifty-three and Fifteen Hundredths (53.15') to an iron pin to be set along said Western right-of- way of Adeline Drive; THENCE along the Western right-of-way of Adeline Drive, South Seventeen Degrees Nineteen Minutes Thirty-one Seconds East, a distance of Eighty-four and Ninety-nine Hundredths feet (84.99') to an iron pin to be set along the Western right-of-way of Adeline Drive; THENCE continuing along the Western right-of-way of Adeline Drive by a curve to the right having a radius of Fourth hundred and Zero Hundredths feet (400.00'), a Chord Bearing of South Sixteen Degrees Twenty- nine Minutes Thirteen Seconds East (S 16° 29' 13" E), an arc length of Eleven and Seventy Hundredths feet (11.70'), and a chord length of Eleven and Seventy Hundredths feet (11.70') to an iron pin to be set along said Western right-of-way of Adeline Drive and Unit No. 17 of Pinehurst Hills and Unit No. 18 of Pinehurst Hills, the point of beginning. BEING Lot No. 17 as shown on the Final Subdivision Plan of the Wafts Tract prepared by Daywood Engineering, Inc. as recorded in Cumberland County Plan Book 81, Page 99. BEING part of the same premises which Albert A. Watts, Jr. by his deed dated June 27, 2000 and recorded August 9, 2000 in the Cumberland County Recorder of Deeds Office in Deed Book 226, Page 1016 granted and conveyed to Pinehurst Hills, L.P., a Pennsylvania limited partnership.
