Colistra, individually and as Executrix of the Estate of Marjorie G. Walmer, Deceased, and David C. Miller, Jr., Esquire, Counsel for the Estate. WHEREAS, Marjorie G. Walmer, who resided at 100 Mt. Allen Drive, Mechanicsburg, Cumberland County, PA 17055, died on July 7, 2011, with a Will, and whose Estate was opened on September 21, 2011, at the above number and term; and WHEREAS, Susan W. Colistra was duly appointed as Executrix of the Estate of Marjorie G. Walmer, Deceased; and WHEREAS, it is the desire of the parties to this Agreement that final distribution of this Estate be accomplished without formal accounting to the Orphans' Court Division of the Court of Common Pleas, G~mberland County, Pennsylvania; and WHEREAS, it is the desire of the parties to this Agreement to receive the following distributive shares of the Estate: A. Colistra acknowledges that the Estate of Marjorie G. Wahner is insolvent and no distributions have been made or will be made. NOW, THEREFORE, WITNESSETH, in consideration of the mutual promises, covenants and agreements recited herein the parties do agree as follows: 1 • Susan W. Colistra, as Executrix, does hereby release and forever discharge David C. Miller, Jr., Esquire, Counsel for the Estate of Marjorie G. Walmer, from any and all liability which may from time to time arise in connection with services rendered as Counsel to the Estate of Marjorie G. Walmer, Deceased. 2. Susan W. Colistra, does hereby acknowledge that the Estate of Marjorie G. Wahner is insolvent pursuant to the fii11 accounting of the Estate assets attached to this Agreement as Exhibit "A", First and Final Account of Susan W. Colistra, Executrix. 3. Susan W. Colistra, Executrix, acknowledges that this Agreement shall be indexed and recorded in the Estate proceedings and that the terms hereof shall be binding upon her respective heirs, successors, administrators, and assigns. 4.
