WHEREAS, an agreement was entered into between:
David M. Martin, Vice President, of Michael L. Martin, Inc., of 584 Grandview Drive, Lewisberry, Pennsylvania
17339, "contractor", and Christopher J. Barnett and Jennifer L. Barnett, his wife, of 1219 Hillside Drive, Carlisle, PA 17013,
"owners",
WHEREBY the said contractor undertook and agreed to perform certain construction work and to provide certain
materials and perform certain work necessary to erect a dwelling for the price or sum of Three Hundred Fifty-six
Thousand Five Hundred Dollars ($356,500.00) on owners' lot situated at: 5 Millfording Road, Mechanicsburg, PA 17055,
NOW, THEREFORE, THIS AGREEMENT W/TNESSETH, That the said contractor for and in consideration of the
sum of One ($1.00) to him in hand paid by the said owner, the receipt whereof is hereby acknowledged, and further
consideration as agreed upon, for him, his sub-contractors and all parties acting through or under him, by him, or any of
them, against the said house of the owner situated as above stated, and the plot of ground appurtenant thereto, for or on
account of any work done or materials furnished by him, or any of them, under said contract or otherwise, for towards, in or
about the said construction and work at the said house of the owners, and the said contractor for himself and his
sub-contractors, and others under him, hereby expressly waives and relinquishes the right to have, file or maintain any
mechanics' lien or claim against the said house and the plot of ground, and agrees that this agreement waiving the right of
lien shall be an independent contract.
IN WITNESS WHEREOF the said contractor and the said owners have executed this agreement on
Michael L. Martin, Inc.

ALL THAT CERTAIN tract or parcel of land being situated in Silver Spring Township,
Cumberland County, Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a point located on the western right-of-way line of Millfording Road (50
foot right-of-way) at the southeast corner of Lot 64 on the hereinafter referenced Plan;
thence along the southern boundary line of Lot 64, North 43 degrees 08 minutes 43
seconds West, a distance of 88.21 feet to a point; thence continuing along the same,
North 82 degrees 48 minutes 43 seconds West, a distance of 431.81 feet to a point along
the Condodoguinet Creek; thence along said creek, South 07 degrees 11 minutes 17
seconds West, a distance of 76.98 feet to a point at the northwest corner of Lot 62; thence
along the northern line of Lot 62, South 82 degrees 48 minutes 43 seconds East, a
distance of 367.97 feet to a point; thence continuing along the same, South 43 degrees 08
minutes 43 seconds East, a distance of 88.21 feet to a point at the northeast corner of Lot
62 and a point on the northern right-of-way line of Millfording Road; thence along
Millfording Road, North 46 degrees 51 minutes 17 seconds East, a distance of 100.00
