Galloway, Esquire, and files this Complaint and in support avers as follows: 1. Plaintiff Myers-Buhrig Funeral Home and Crematory is a limited company organized under the laws of Pennsylvania with a principal address of 37 E. Main St., Mechanicsburg, PA 17055. 2. Upon information and belief, Defendant Kenneth Keiter is an adult individual with a last known address of 30 Carlisle Road, Newville, PA 17241. 3. Upon information and belief, Defendant Shirley K. Bryner is an adult individual with a last known address of 102 Ridge Dr., Shermansdale, PA 17090. 4. On or about October 4, 2011, Plaintiff and Defendant entered into a written agreement for funeral services related to the death of Cheri Eileen Keiter. A copy of the written agreement (hereinafter "Agreement") is attached hereto. 5. Plaintiff fulfilled, performed and complied with all obligations and conditions of the Agreement. 6. Defendants breached the expressed and implied obligations, conditions and terms of the Agreement by failing to pay the amounts due. 7. Pursuant to the Agreement, interest is accruing on the unpaid balance at the rate of 1.5% per month (18% per annum). 8. As of the date of this Complaint, the amount due and owing from Defendants to the detriment of Plaintiff is $6,996.97. 9. Pursuant to the Agreement, Defendant agreed to pay "attorneys' fees, court costs and other costs." 10. Plaintiff has calculated reasonable attorneys' fees to be 25% of the principal amount due or $1,502.50. WHEREFORE, Plaintiff respectfully requests this Honorable Court enter Judgment in favor of the Plaintiff and against Defendant in the amount of $8,499.47, plus costs of this action, and any other relief as this Court deems just and reasonable.
