Plaintiff is a business organization licensed and authorized to conduct business in the State of Illinois with a place of business located at P.O. Box 2371, Bloomington, Illinois 61702. 2. Defendant, George W. Weaver & Son. Inc., is a business organization licensed and authorized to conduct business in the Commonwealth of Pennsylvania and having as one of its places of business 165 Lamont Street, New Cumberland, Pennsylvania 17070. 3. At all times pertinent hereto, State Farm agreed to insure the property of its insured located at 22 Sycamore Drive, Mechanicsburg, Pennsylvania, hereinafter "the Property", pursuant to a policy of insurance. 4. On or about August 5, 2011 the Plaintiff Insured's hired Defendant as a mover. ~ , r 5. On or about the above date, the agents, servants, workmen and/or employees of Defendant did move and hook up and/or install the Plaintiff Insured's washer and dryer. 6. After the washer and dryer were hooked up and/or installed by Defendant's agents, servants, workmen and/or employees, water from the washer did then damage the Property. 7. This damage to the Property was the direct result of Defendant's agents, servants and/or workmen's negligence and/or careless in the hook up and or installation of the washer which consisted, inter olio, of: a. Creating an unsafe condition at the property; b. Failing to utilize due care when using installing and/r hooking up the washer; c;. Failing to test the washer after it was installed and/or hooked up to make sure it was properly installed; d. Being otherwise negligent under the circumstances; and, e. Being negligent as a matter of law as may be relevant through discovery and/or at the time of trial. 8. As a direct and proximate result of Defendant's negligence, the State Farm Insured's property sustained property damage in the amount of $13,292.90. Attached as Exhibit 1 is a copy of those document which Plaintiff intends to introduce into evidence at the arbitration of this matter. 9. Pursuant to the insurance policy issued by State Farm and as a result of the aforesaid payment, State Farm became subrogated to the claim of its Insured against Defendant. c WHEREFORE, Plaintiff demands Judgment against Defendant in the amount of $13,292.90 plus interest and costs.
